EXHIBIT 3 <br />CITYOFSANTAANA <br />CONSTRUCTION CONTRACTAGREEMENT <br />PROJECTNO.:16-7566 <br />MYRTLEPARK <br />RAITT <br />st <br />ThisCONSTRUCTIONCONTRACTismadeandenteredintothis 21dayof September, 2021 byand <br />between the City of SantaAna,California, a chartercityandmunicipalcorporationorganizedand <br />existing under the Constitution and laws of the State of California (hereinafter “CITY”), and CEM <br />Construction (hereinafter “CONTRACTOR”). <br />WITNESSETH: <br />TheCITYand the CONTRACTOR,for the considerationhereinafternamed,mutuallyagreeas follows: <br />1.CONTRACTORagreestoperformall the workandfurnishall the materialsatitsowncostand <br />expensenecessary to construct andcompletein a good and workmanlike mannerandtothe <br />satisfaction of theCityEngineer of the CITY, the Raitt and Myrtle Park Project (hereinafter referred <br />to as the “WORK OF IMPROVEMENT”) identifiedin and in accordance withthe Contracts <br />Documents prepared by the City’sPublic Works Agency and approved by the City Council. <br />2. <br />Standard SpecificationsforPublic Works Constructionandwhich include the following: <br />Notice Inviting Bids <br />Information toBidders <br />Bid Proposal <br />BidBond <br />ContractForm <br />ContractBonds <br />GeneralProvisions <br />SpecialProvisions <br />TechnicalProvisionsandProjectPlans <br />Community WorkforceAgreement <br />Appendices <br />Incase of conflictbetween the Contract Documents, the precedence of documentsshall be as <br />establishedin the StandardSpecificationsfor Public Works Construction. <br />3.CITYagreesto pay andCONTRACTORagreestoacceptinfull payment tocomplete the WORK <br />OFIMPROVEMENTthe sum totalamount not toexceed Two Million Seven Hundred Seventy Six <br />Thousand Four Hundred Six and No Cents ($2,776,406), assetforthandidentifiedin the BID <br />PROPOSAL,whichis attached hereto and incorporated herein as “Exhibit A.” <br />TheBIDPROPOSAL contains a schedule of unit price(s) or lumpsum(s)based on approximate <br />quantitiesonly,and the City does not expressly or byimplicationagreethat the actual amount of <br />workwillcorrespondtherewith,butreserves the righttoincrease or decrease the amount of any <br />class or portion of the work or toomitportions of the workasmay be deemednecessary or <br />advisable. <br />1of3 <br /> <br />
