EXHIBIT 3 <br />CITYOFSANTAANA <br />CONSTRUCTION CONTRACTAGREEMENT <br />PROJECTNO.:16-7566 <br />MYRTLEPARK <br />RAITT <br />4.CONTRACTORagreestocomplete the WORKOFIMPROVEMENTwithin the timespecifiedin <br />commencing constructionwithinthe timeframetherein specifiedafter issuanceof a Noticeto <br />Proceed. <br />5.TheCONTRACTORwillpay,andwillrequireallsubcontractorstopay,allemployees on the <br />WORKOFIMPROVEMENT a salary or wageatleastequalto the prevailing salaryorwage <br />establishedforsuchworkassetforthin the wage determinations forthisworkinaccordancewith <br />applicable StateandFederallaw. <br />6. If applicable, the CONTRACTORshall adhereto the CITY’SCommunity Workforce Agreement <br />(CWA), a pre-hirecollective bargaining agreement,whichestablishes the labor relations policiesand <br />proceduresforCONTRACTOR to followin the crafts persons employed tocomplete the WORKOF <br /> <br />websiteat: <br />http://www.santa-ana.org/pwa/documents/CWA.pdf <br />7.CONTRACTORshall,afteraward of thisContract,furnishtwo bonds to be approved by the CITY, <br />one in the amount of One Hundred Percent(100%) of the Contractprice,toguarantee the faithful <br />performance of the work(Performance Bond), and one in the amount of One Hundred Percent <br />(100%) of the Contractpricetoguaranteepayment of allclaimsforlaborandmaterials furnished <br />(Payment Bond). ThisContractshall not becomeeffective until such bonds are supplied toand <br />approved by the CITY. <br />8.CONTRACTORshall,priorto the release of the performanceand payment bonds or the retention <br />payment, furnish a warrantyperformanceandpayment bond(Warranty Bond). SaidWarranty Bond <br />shallalso be requiredas a condition of projectacceptance.Forprojects up toFiveHundred <br />Thousand Dollars ($500,000), the WarrantyBondamountshall be the greater of TenThousand <br />Dollars ($10,000) or TwentyPercent(20%) of the finalcontractprice.Forprojects above Five <br />Hundred ThousandDollars ($500,000), the Warranty Bond amount shall be the greater of One <br />Hundred ThousandDollars ($100,000) or TenPercent(10%) of thefinalcontractprice. <br />9.CONTRACTORshall,afteraward of thisContract,furnishCertificates of Liability Insurance and <br />CITY. <br />10.INDEMNIFICATION. <br />To the fullestextentallowedbylaw,CONTRACTORandits Subcontractors herebyagreetodefend, <br />indemnify, and hold harmlessCITY,itsCity Council, boards andcommissions,officers,agents, <br />employees,representativesandvolunteers(hereinaftercollectivelyreferredtoas"Indemnitees"), <br />through legal counsel acceptabletoCITY,fromandagainstanyliability,claims,actions,costs, <br />damage <br />person or damagetoany property, arisingdirectly or indirectlyfrom, or inanymannerrelatingto, <br />anyof the following: <br />(i)Performance or nonperformance of the Workof Improvement byCONTRACTOR or its <br />Subcontractors of anylowertier; <br />(ii)Performance or nonperformance byCONTRACTOR or its Subcontractors of anylowertier, <br />2of3 <br /> <br />
