City employment; <br />1) Solid Waste Handling Services for governmental agencies other than City, which <br />may have facilities in City, but over which City has no jurisdiction in connection <br />with the regulation of Solid Waste; <br />m) Solid Waste Handling Services for Solid Waste originating outside the City from <br />hauling such Solid Waste over City streets, provided such collectors comply with <br />any governing laws and/or ordinances; <br />n) Contractor's right to Collect and/or Dispose of Solid Waste shall not be exclusive <br />in the event of failure to Collect under Article 10 of this Agreement during which <br />Contractor fails to maintain substantially complete regular Collection services <br />pursuant to this Agreement and the Collection schedules then in effect, for any <br />reason, including a strike by Contractor's employees or similar labor dispute. <br />The City may provide for Collection and/or Disposal services from persons <br />other than Contractor during such periods, including Contractor's Bin and/or <br />Roll -off Service Customers; <br />o) Food Waste or other Organic Materials diverted from Disposal by delivery to <br />hog farms or otherwise used as animal feed; <br />p) Edible food recovered for human consumption; <br />q) Collection services already lawfully provided by another contractor in any <br />territory that has been annexed to the City during the term of this Agreement, as <br />more specifically described in Section 2.14; <br />r) Used motor oil and used motor oil filter Collection services provided under <br />Section 4.2.12; <br />s) Other Persons with the right to provide Collection services for Construction and <br />Demolition to the extent required by Public Resources Code Section 49520 and <br />other applicable law, if any. <br />Contractor acknowledges and agrees that City may permit other Persons besides <br />Contractor to Collect any or all types of the Solid Waste listed in this Section 2.9 as <br />exempt from Contractor's Franchise, including Recyclable Materials, without seeking or <br />obtaining approval of Contractor under this Agreement. <br />August 17, 2021 31 City of Santa Ana <br />
