EXHIBIT 2 <br />Stabilization and Just Cause Eviction Ordinance" and, for the sake of convenience, as <br />the "Rent Stabilization and Just Cause Eviction Ordinance." <br />Section 8-3101 — Background <br />The Rent Stabilization Ordinance, previously adopted by the City Council on <br />October 19, 2021, and the Just Cause Eviction Ordinance, also previously adopted by <br />the City Council on October 19, 2021, are hereby amended pursuant to this newly <br />adopted Rent Stabilization and Just Cause Eviction Ordinance. <br />Section 8-3102 — Definitions <br />a) For purposes of this Article, the words and phrases shall be defined as set <br />forth herein, unless the context clearly indicates a different meaning is intended. <br />b) Words and phrases used in this Article, which are not specifically defined, <br />shall be construed according to their context and the customary usage of the language. <br />c) Words and phrases defined: <br />"Annual Allowable Rent Adjustment" means the limit on the Maximum <br />Allowable Rent increase, which a Landlord may charge on any Rental Unit <br />each year. <br />"Capital Improvement" means an improvement, addition or major repair to <br />a Rental Unit that were paid for and completed after November 19, 2021 <br />(the effective date of the first adopted Rent Stabilization Ordinance), <br />provided such new improvement, addition or major repair has a useful life <br />of five (5) years or more and that is required to be amortized over the <br />useful life of the improvement, such as: structural, electrical, plumbing, or <br />mechanism system, roofing, flooring, including carpeting,air conditioning, <br />security pates, swimming pool, sauna or hot tub„ children's play <br />equipment permanently installed„ and other similar improvements as <br />defined under the straight line depreciation provisions of the Internal <br />Revenue Code and the regulations issued pursuant thereto and <br />determined by the Rental Housing Board. Capital Improvement does not <br />include normal or routine maintenance, repair, replacements, and/or <br />deterioration resulting from an unreasonable delay in the undertaking of <br />completion or after a Notice of Violation by a government agency ordering <br />repairs. <br />"Change of Use" means a use of a Mobilehome Park for a purpose other <br />than the rental, or the holding out for rent, of two or more Mobilehome sites <br />to accommodate Mobilehomes used for human habitation, and does not <br />mean the adoption, amendment, or repeal of a Mobilehome Park rule or <br />regulation. A Change of Use may affect an entire Mobilehome Park or any <br />portion thereof and includes conversion to any form of ownership wherein <br />spaces within the park are to be sold. <br />"City" means the City of Santa Ana. <br />Page 3 of 46 <br />
