Local Guidelines for Implementing the <br />California Environmental Quality Act (2023) ENVIRONMENTAL IMPACT REPORT <br /> <br /> <br />2023 City of Santa Ana Local Guidelines 7-25 ©Best Best & Krieger LLP <br />A project will not be invalidated due to a failure to send a requested Notice provided there has <br />been substantial compliance with these notice provisions. <br />Staff may also consult with and obtain comments from any person known to have special <br />expertise or any other person or organization whose comments relative to the Draft EIR would be <br />desirable. <br />Notice shall be given to the last known name and address of all organizations and <br />individuals who have previously requested notice; by posting the notice on the website of the lead <br />agency; and by at least one of the following : <br />(a) Publication of the Notice of Completion and/or the Notice of Availability at least once in <br />a newspaper of general circulation in the area affected by the proposed project. If more <br />than one area will be affected, the notice shall be published in the newspaper of largest <br />circulation from among the newspapers of general circulation in those areas; <br />(b) Posting of the Notice of Completion and/or the Notice of Availability on and off site in the <br />area where the project is to be located; or <br />(c) Direct mailing of the Notice of Completion and/or the Notice of Availability to owners and <br />occupants of property contiguous to the project, as identified on the latest equalized <br />assessment roll. <br />The Notice of Completion and Notice of Availability shall be posted in the office of the <br />Clerk in each county in which the project is located for at least thirty (30) days. If the public <br />review period for the Draft EIR is longer than thirty (30) days, the City may wish to leave the <br />Notice posted until the public review period for the Draft EIR has expired. <br />Copies of the Draft EIR shall also be made available at the City office for review by <br />members of the general public. The City may require any person obtaining a copy of the Draft <br />EIR to reimburse the City for the actual cost of its reproduction. Copies of the Draft EIR should <br />also be furnished to appropriate public library systems. <br />The City shall also post an electronic copy of the Notice of Completion, Notice of <br />Availability, and Draft EIR on its website, if any. <br />(Reference: Pub. Resources Code, § 21082.1; State CEQA Guidelines, §§ 15085, 15087.) <br />7.26 SUBMISSION OF DRAFT EIR TO STATE CLEARINGHOUSE. <br />A Draft EIR must be submitted to the State Clearinghouse, at the same time as the Notice <br />of Completion, in an electronic form as required by the Office of Planning and Research, regardless <br />of whether the document must be circulated for review and comment by state agencies under State <br />CEQA Guidelines section 15205 and 15206. The Draft EIR must be submitted via the Office of <br />Planning and Research’s CEQA Submit website <br />(https://ceqasubmit.opr.ca.gov/Security/LogOn?ReturnUrl=%2f). The CEQA Submit website <br />differentiates between environmental documents that do require review and comment by state <br />agencies and those that do not.
