Local Guidelines for Implementing the <br />California Environmental Quality Act (2023) TYPES OF EIRS <br /> <br /> <br />2023 City of Santa Ana Local Guidelines 8-8 ©Best Best & Krieger LLP <br />When the Lead Agency cannot find that the subsequent project will have no additional <br />significant environmental effect and no new mitigation measures or alternatives will be required, <br />it must prepare either a Mitigated Negative Declaration or an EIR for the subsequent project. <br />(Reference: State CEQA Guidelines, § 15175.) <br />8.12 FOCUSED EIR. <br />A Focused EIR is an EIR for a subsequent project identified in a Master EIR. It may be <br />used only if the City finds that the Master EIR’s analysis of cumulative, growth-inducing, and <br />irreversible significant environmental effects is adequate for the subsequent project. The Focused <br />EIR must incorporate by reference the Master EIR. <br />The Focused EIR must analyze additional significant environmental effects not addressed <br />in the Master EIR and any new mitigation measures or alternatives not included in the Master EIR. <br />“Additional significant effects on the environment” means those project-specific effects on the <br />environment that were not addressed as significant effects on the environment in the Master EIR. <br />The Focused EIR must also examine the following: <br />(a) Significant effects discussed in the Master EIR for which substantial new information <br />exists that shows those effects may be more significant than described in the Master EIR; <br />(b) Those mitigation measures found to be infeasible in the Master EIR for which substantial <br />new information exists that shows the effects may be more significant than described in <br />the Master EIR; and <br />(c) Those mitigation measures found to be infeasible in the Master EIR for which substantial <br />new information exists that shows those measures may now be feasible. <br />The Focused EIR need not examine the following effects: <br />(a) Those that were mitigated through Master EIR mitigation measures; or <br />(b) Those that were examined in the Master EIR in sufficient detail to allow project-specific <br />mitigation or for which mitigation was found to be the responsibility of another agency. <br />A Focused EIR may be prepared for a multifamily residential project not exceeding 100 <br />units or a mixed use residential project not exceeding 100,000 square feet even though the project <br />was not identified in a Master EIR, if the following conditions are met: <br />(a) The project is consistent with a general plan, specific plan, community plan, or zoning <br />ordinance for which an EIR was prepared within five (5) years of the Focused EIR’s <br />certification; <br />(b) The project does not require the preparation of a Subsequent or Supplemental EIR; and <br />(c) The parcel is surrounded by immediately contiguous urban development, was previously <br />developed with urban uses, or is within one-half mile of a rail transit station. <br />A Focused EIR for these projects should be limited to potentially significant effects that <br />are project-specific and/or which substantial new information shows will be more significant than
