INITIAL STUDY <br />5.01 PREPARATION OF INITIAL STUDY. <br />If the City determines that it is the Lead Agency for a project which is not exempt, the City <br />will normally prepare an Initial Study to ascertain whether the project may have a substantial <br />adverse effect on the environment, regardless of whether the overall effect of the project is adverse <br />or beneficial. All phases of project planning, implementation and operation must be considered in <br />the Initial Study. An Initial Study may rely on expert opinion supported by facts, technical studies <br />or other substantial evidence. However, an Initial Study is neither intended nor required to include <br />the level of detail included in an EIR. <br />The City, as Lead Agency, may use any of the following arrangements or combination of <br />arrangements to prepare an Initial Study: <br />(1) Preparing the Initial Study directly with the City’s own staff. <br />(2) Contracting with another entity, public or private, to prepare the Initial Study. <br />(3) Accepting a draft Initial Study prepared by the applicant, a consultant retained by <br />the applicant, or any other third person. <br />(4) Executing a third party contract or memorandum of understanding with the <br />applicant to govern the preparation of an Initial Study by an independent contractor. <br />(5) Using a previously prepared Initial Study. <br />The Initial Study sent out for public review, however, must reflect the independent <br />judgment of the Lead Agency. <br />For private projects, the person or entity proposing to carry out the project shall complete <br />Form “I” of these Local CEQA Guidelines, submit the completed Form “I” to the City, and submit <br />all other data and information as may be required by the City to determine whether the proposed <br />project may have a significant effect on the environment. All costs incurred by the City in <br />reviewing the data and information submitted, or in conducting its own investigation based upon <br />such data and information, or in preparing an Initial Study for the project shall be borne by the <br />person or entity proposing to carry out the project. <br />(Reference: State CEQA Guidelines, §§ 15063, 15084.) <br />5.02 INFORMAL CONSULTATION WITH OTHER AGENCIES. <br />When more than one public agency will be involved in undertaking or approving a project, <br />the Lead Agency shall consult with all Responsible and any Trustee Agencies. Such consultation <br />shall be undertaken in compliance with the notice procedures applicable to the type of CEQA <br />document being prepared. See Section 6.04, Negative Declarations, and Sections 7.03 and 7.25, <br />EIRs.
