Police Oversight Informational Report <br />September 7, 2021 <br />Page 3 <br />2 <br />0 <br />3 <br />7 <br />City of Berkeley, CA <br />City: Berkeley,CA <br />Police Oversight Mechanism Name: Police Accountability Board <br />Responsibilities: <br />o To advise and make recommendations to the public, City COuncil, and City <br />Manager regarding the operation of the Berkeley Police Department, including <br />all written policies, practices, and procedures in relations to the Berkeley Police <br />Department. <br />o Review and recommend for City Council approval all agreements, letters, <br />memoranda of understanding, or policies which express terms and conditions <br />of mutual aid, information sharing, cooperation and assistance between the <br />Berkeley Police Department, and all other local, state and federal law <br />enforcement, intelligence, and military agencies or private security <br />organizations. <br />o To receive and consider the findings and recommendations of the Director of <br />Police Accountability regarding complaints filed by the members of the public <br />against sworn employees of the Police Department and to recommend if <br />discipline is warranted when misconduct is found and the level of discipline for <br />sustained findings of misconduct. <br />o To participate in the hiring of the Chief of Police. <br />o To access records of City Departments, compel attendance of sworn <br />employees of the Police Department, and exercise the power of subpoena as <br />necessary to carry out its functions. <br />o To adopt rules and regulations necessary for the conduct of its business. <br />o Any other powers and duties as the City Council may assign it by Ordinance. <br />Membership: <br />o Nine Berkeley residents are appointed by the Berkeley Mayor and City Council. <br />o Be a resident of the City. <br />o Be at least 18 years old. <br />o Not be an employee, officer, or contractor with the City. <br />o Be fair-minded and objective with a demonstrated commitment to community <br />service. <br />o Members’ terms end four years after appointment, or upon expiration of the <br />nominating City Council Member’s term, whichever is earlier. <br />Staff: Director of Police Accountability <br />Annual Operating Budget: $1,113,102 <br />City of Oakland, CA <br />City: Oakland, CA <br />Police Oversight Mechanism Name: Oakland Police Commission/Community <br />Police Review Agency <br />Responsibilities: <br />o The Commission: <br />Oversee the Police Department’s policies and procedures.
