County of Orange <br />OC Community Resources <br />Page 26 of 42 City of Santa Ana <br />Contract No.:MA-012-22010003 <br /> <br />Program Specific Terms and Conditions: <br /> <br />37. Debarment: Contractor shall execute and abide by the Debarment & Suspension Certification, <br />attached hereto as Exhibit 2 and incorporated herein by this reference, and by so doing declares <br />that it is not debarred or suspended or otherwise excluded from or ineligible for participation in <br />Federal/State assistance programs in accordance with 29 C.F.R. Part 98. <br /> <br />38. Lobbying Certification: <br /> <br />A. Contractor shall execute and abide by the terms of the “Certification Regarding <br />Lobbying,” which is attached hereto as Exhibit 3 and incorporated herein by this reference. <br />Contractor shall complete and immediately forward to the County’s Project Manager the <br />“Disclosure Form to Report Lobbying,” a copy of which is attached hereto as Exhibit 4 <br />and incorporated herein by this reference, if Contractor, or any person, firm or corporation <br />acting on Contractor’s behalf, engaged or engages in lobbying any federal office, <br />employee, elected official or agency with respect to this Contract or funds to be received <br />by Contractor pursuant to this Contract. <br />B. Contractor agrees that the funds provided herein shall not be used to promote, directly or <br />indirectly, any political party, political candidate or political activity, except as permitted <br />by law. <br />C. Contractor shall be in compliance with the Byrd Anti-Lobbying Amendment (31 U.S.C. <br />1352 and 29 CFR Part 93). <br /> <br />39. Fraud: Contractor shall immediately report to the County’s Project Manager, in writing, all <br />suspected, alleged, or known instances and facts concerning possible fraud, abuse or criminal <br />activity by either Contractor or its Subcontractor(s) under this Contract. Contractor shall inform <br />staff and the general public of how to report fraud, waste or abuse through appropriate postings <br />of incident reporting notice. The County’s Anti-Fraud Program can be accessed through: <br />http://ocgov.com/gov/risk/programs/antifraud. <br /> <br />Contractor shall maintain records, documents, or other evidence of fraud and abuse until <br />otherwise notified by County. <br /> <br />40. Fiscal Appropriations: This Contract is subject to and contingent upon available local, state, <br />and/or federal funds and applicable budgetary appropriations being approved by the County of <br />Orange Board of Supervisors for each fiscal year during the term of this Contract. If such <br />appropriations are not approved, the Contract will be terminated, without penalty to the County. <br /> <br />41. Fiscal Accountability: <br /> <br />A. Contractor shall establish and maintain a sound financial management system, based upon <br />generally accepted accounting principles. Contractor’s system shall provide fiscal control <br />and accounting procedures that will include the following: <br /> <br />1. Information pertaining to sub-grant and Contract awards, obligations, unobligated <br />balances, assets, expenditures, and income; <br /> <br />2. Effective internal controls to safeguard assets and assure their proper use;
