EXHIBIT 4 <br />jmf 1/05/21 <br />RESOLUTION NO. 2021-XXX <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA DENYING APPEAL APPLICATION NOS. 2020- <br />03 AND 2020-04 AND UPHOLDING THE DETERMINATION <br />OF THE PLANNING COMMISSION TO APPROVE SITE <br />PLAN REVIEW NO. 2020-04 AS CONDITIONED FOR A NEW <br />MIXED -USE RESIDENTIAL AND COMMERCIAL <br />DEVELOPMENT FOR THE PROPERTY LOCATED AT 1801 <br />EAST FOURTH STREET <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines, <br />and declares as follows: <br />A. On November 9, 2020, the Planning Commission of the City of Santa Ana, <br />following a duly noticed public hearing, adopted a resolution approving Site <br />Plan Review No. 2020-04, as conditioned, to allow the construction of a new <br />mixed -use development consisting of 644 multi -family residential units and <br />15,130 square feet of commercial space at 1801 East Fourth Street ("Central <br />Point Project" or "Project"). <br />B. Pursuant to Santa Ana Municipal Code Section 41-645, an appeal from a <br />decision of the Planning Commission can be made by an interested party, <br />individual or group. <br />C. On November 16, 2020, Rebecca Davis with Lozeau Drury LLP, on behalf <br />of the Supporters Alliance for Environmental Responsibility (SAFER), <br />submitted Appeal Application No. 2020-03 pursuant to Section 41-645 of <br />the Santa Ana Municipal Code (SAMC) requesting that the City Council <br />reconsider the Planning Commission's decision based on the following <br />reasons: <br />The City failed to comply with the California Environmental Quality <br />Act by failing to prepare a Supplemental Environmental Impact <br />Report or Tiered Environmental Impact Report for the project. <br />D. On November 19, 2020, John Hanna, on behalf of the Southwest Regional <br />Council of Carpenters (SWRCC), submitted Appeal Application No. 2020-04 <br />pursuant to Section 41-645 of the Santa Ana Municipal Code requesting <br />that the City Council reconsider the Planning Commission's decision based <br />on the following reasons: <br />Failure to adequately address affordable housing. <br />Resolution No. 2021-XXX <br />Page 1 of 12 <br />
