MM-OZ 4.4-3 In the event that archeological resources are unearthed during project <br />subsurface activities, all earth -disturbing work within a 100-meter radius must <br />be temporarily suspended or redirected until an archeologist has evaluated the <br />nature and significance of the find. After the find has been appropriately <br />mitigated, work in the area may resume. <br />MM-OZ 4.4-5 If human remains are unearthed, State Health and Safety Code Section 7050.5 <br />require that no further disturbance shall occur until the County coroner has <br />made the necessary findings as to origin and disposition pursuant to Public <br />Resources Code Section 5097.98. If the remains are determined to be of <br />Native American descent, the coroner has 24 hours to notify the Native <br />American Heritage Commission (NAHC). The NAHC will then contact the most <br />likely descendant of the deceased Native American, who will then serve as <br />consultant on how to proceed with the remains. <br />4.5.2 Does the Project propose changes that would result in new significant impacts or <br />substantial increase in the severity of significant impacts that will require major revisions <br />of the Certified EIR? <br />The Project includes the demolition and removal of all existing improvements from the Project <br />Site and development of the site with a mixed -use development including up to 507 residential <br />dwelling units, approximately 26,800 square feet of commercial uses, and associated parking, <br />utility infrastructure, landscaping, and open space, all of which is allowed under the Overlay Zone, <br />and is consistent with the Overlay Zone standards. The Project does not include any development <br />that would extend beyond the building envelope considered in the Certified EIR, and no changes <br />are proposed to the Overlay Zone to accommodate the Project. As discussed below, the Project <br />will incorporate mitigation measures to minimize impacts related to cultural resources would be <br />less than significant, and accordingly, would not result in any new or increased significant impacts <br />to cultural resources beyond those already identified in the Certified EIR. <br />Historic Resources <br />The Certified EIR concluded that redevelopment of sites within the Overlay Zone could result in <br />the demolition or major modification of historically -aged structures which have not yet been <br />evaluated to determine their significance as defined by Section 15064.5 of the CEQA Guidelines, <br />and this was considered a significant impact. The Project Site contains four structures <br />construction between 1971 and 1978, only one of which is over 50 years (the office building <br />located at 1971 East 4th Street). In compliance with MM-OZ 4.4-1, a Historic Resources <br />Assessment was prepared for the Project by LSA, dated July 2022 (refer to Attachment B). The <br />assessment included archival research, outreach to local historical groups, a field survey, and a <br />written analysis. The purpose of the assessment is to provide the City with the necessary <br />information and analysis to determine, as mandated by CEQA, whether the Project would cause <br />substantial adverse changes to any historical resources that may exist in or around the Project <br />Site area.
