The Certified EIR concluded that implementation of the Overlay Zone has the potential to cause <br />a substantial adverse change in the significance of an archaeological resource pursuant to <br />Section 15064.5 of the CEQA Guidelines, but implementation of Mitigation Measures MM-OZ 4.4- <br />2 through MM-OZ 4.4-4 that require monitoring by a qualified archaeologist during any ground - <br />disturbing activities below 10 feet below ground surface, evaluation of any uncovered resources, <br />and coordination with the County Coroner and the NAHC if human remains are uncovered would <br />ensure that impacts related to unknown archaeological resources, including tribal cultural <br />resources, will be less than significant. <br />As discussed previously in this document, the Project would include excavation beyond 10 feet <br />below ground surface and would be required to implement Mitigation Measures MM-OZ 4.4-2 and <br />MM-OZ 4.4-3, requiring construction monitoring by a qualified archeologist and certain actions in <br />the event that a potential resource is encountered during Project construction. Thus, the Project <br />would not result in any new or increased significant impacts related to archaeological resources, <br />including tribal resources, beyond impacts already identified in the Certified EIR. <br />Mitigation Measures <br />Not applicable. <br />4.17.3 Any substantial changes in circumstances involving new significant impacts or <br />substantial increase in the severity of significant impacts that will require major revisions <br />of the Certified EIR? <br />No substantial changes in the circumstances related to tribal cultural resources have occurred, <br />and no substantial new sources of tribal cultural resources have been identified within the vicinity <br />of the Project since the certification of the Certified EIR that would result in new or more severe <br />significant environmental impacts. <br />4.17.4 Any new information of substantial importance that demonstrates that the Project <br />would result in new significant impacts or substantial increase in the severity of significant <br />impacts? <br />There is no new information of substantial importance which has become available relative to <br />tribal cultural resources that would result in new or more severe significant environmental impacts. <br />4.17.5 Mitigation Measures Addressing Impacts <br />Not applicable. <br />4.17.6 Conclusion <br />Based on the above, no new significant tribal cultural resources or a substantial increase in <br />previously identified tribal cultural resources would occur as a result of the Project.
