Additionally, the California Integrated Waste Management Act of 1989 (AB 939) requires that local <br />jurisdictions divert at least 50 percent of all solid waste generated by January 1, 2000. Per the <br />City Program, individual projects within the Overlay zone would be required to comply with the <br />Source Reduction and Recycling Element (SRRE) program for diverting the solid waste. The City <br />already diverts 60 percent of its solid waste generated and is well above the compliance levels. <br />Under the SRRE program, implementation of the Overlay Zone would be consistent with AB 939 <br />as well. Thus, a less -than- significant impact would occur. No mitigation is required. <br />Mitigation Measures <br />MM-OZ 4.13-1 The developer is required to undertake a site -specific sewer evaluation, <br />including flow monitoring required as part of the project design to determine <br />the adequacy of the existing sewer pipe capacity in the affected project area <br />lines. <br />MM-OZ 4.13-2 The project shall implement energy conservation measures (such as energy - <br />efficient lighting and micro -processor -controlled HVAC equipment) to reduce <br />the demand for electricity and natural measures shall be subject to modification <br />as new technologies are developed or if current technology becomes obsolete <br />through replacement. <br />4.18.2 Does the Project propose changes that would result in new significant impacts or <br />substantial increase in the severity of significant impacts that will require major revisions <br />of the Certified EIR? <br />The Project includes the demolition and removal of all existing improvements from the Project <br />Site and development of the site with a mixed -use development including up to 507 residential <br />dwelling units, approximately 26,800 square feet of commercial uses, and associated parking, <br />utility infrastructure, landscaping, and open space, all of which is allowed under the Overlay Zone, <br />and is consistent with the Overlay Zone standards. The Project does not include any development <br />that would extend beyond the permitted uses, density, and intensity or building envelope <br />considered in the Certified EIR, and no changes are proposed to the Overlay Zone to <br />accommodate the Project. The Project's water demand is within the envelope of projected water <br />usage analyzed as part of the WSA conducted for the Certified EIR that concluded the uses and <br />development density and intensity proposed within the Overlay Zone could be adequately served <br />by the water purveyor. As discussed below, the Project would incorporate mitigation measures to <br />further minimize impacts related to utilities and service systems, and accordingly, would not result <br />in any new or increased significant impacts beyond those already identified in the Certified EIR. <br />The Project's water and wastewater treatment requirements have been accounted for in the <br />Certified EIR. The Project would be required to implement MM-OZ 4.7-2, which requires <br />preparation of a Hydrology and Hydraulic Study to ensure the existing storm drain capacity could <br />accommodate the Project. Further, the Project's energy consumption and solid waste generation <br />has also been accounted for in the Certified EIR.
