<br />The Mayor announced that the hour of 1:00 P.M. had arrived and
<br />this is the time and place fixed for hearing protests, objections
<br />or appeals concerning that certain sanitary sewer and water work
<br />done under the Improvement Act of 1911 and Resolution No. 3858,
<br />adopted on October 17, 19~9. ~.
<br />
<br />The Clerk presented affidavit of posting notice of filing of
<br />assessment for said work, affidavit of mailing of such notice and
<br />affidavit of publication of such notice. Motion was made by
<br />Trustee Chandler, seconded by Trustee Reed and carried, that said
<br />affidavits be approved and placed on file.
<br />
<br />The Mayor stated that certain written communications or appeals
<br />had been filed with the Clerk. The Clerk read protests of
<br />Myrtle A.B.Brewster, owner of Lot 3, Block 14, Tract No. 560.
<br />Winthrop Gordon, representing B.C.Skinner, filed written protest
<br />to proposed improvement under the Improvement Act of 1911 on the
<br />westerly 125 feet of the northerly 322.05 feet of Block "E", of
<br />Tract No. 969, and requested that the assessment on said property
<br />be spread over assessments on other property within the district.
<br />On motion of T~ustee Cheney, seconded by Reed and carried, pro-
<br />tests were received and filed. E.A.Ruddy, 2086 Standard Avenue
<br />objected to request of Winthrop Gordon, on behalf of hi~ client,
<br />to spread the cost of assessment of B.C.Skinner to be spread to
<br />other property owners. William Toohey, 2121 Oak Street, asked
<br />if the work on the street pavement was included in the assessment
<br />cost, which question was answered fully by the City Engineer.
<br />All questions were answered by the City Engineer and Bonding
<br />Attorney. No further protests were made and the Mayor ordered
<br />the hearing closed.

<br />On motion of Trustee Reed, seconded by Chandler and carried, the
<br />following ResolutiOn entitled:
<br /> "Resolution of the~Oity Council of the City
<br /> of Santa Ana, California, making determinations
<br /> and confirming assessment and proceedings"

<br />was read, considered, designated Resolution No. 4001 and passed by
<br />~the following vote:

<br />to Safeway Stores, Inc.~ to permit operation of a parking lot on
<br />Lots 20, 22, 24 and 26 in Block "C" of Tract No. 245, being 1438-
<br />1450 Cypress Avenue, subject to conditions, was read,
<br />
<br />N~s. Vieira, 1437 Cypress Ave., and Milton Foster, 1408 Cypress Ave
<br />appeared before the Board protesting granting of variance. James
<br />Utt, representing Safeway Stores, Inc., presented a petition signed
<br />by fifteen adjacent property owners in favor of granting the
<br />variance. The Resolution was considered, designated Resolution
<br />No. 4002 and passed by the following vote:
