RESOLUTION NO. 1994 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA, CALIFORNIA, RELATING TO THE ISSUANCE OF STREET INPROVEME~ BONDS PURSUANT TO RESOLUTION OF INTENTION NO. 184~; DETERMINING THE AMOUNT OF ~PAID ASSESSMENTS; PRESCRIBING THE DEN~IIN~TION OF SUCH BONDS A~ PROVIDING FOR THEIR ISSUANCE IN ANNUAL SERIES: ~{ERE~S, pursuant to statute, no~ice of the filing or list of unpaid assessments was duly given in ~he manner and form required Oy law, that the warrant, assessment and diagram was recorded on the 26th day of June, i928, for ~he work and improvement made oy ~ells and ~ressler, unger that certain contract awarded ~o them on the 19th Gay of December, 1927, upon a portion of Patton ot~eet, as set I'or~h in Resolution of Intention so. i843; and that said warrant, assessment and diagram were returned to ~he Street superintendent of said City, ~ogether with a w~itten statement of all payments received upon the said assessment; and after the full expira=ion of thirty (30) days after ~he recording of said warrant, the said ~t~eet Superintenden~ duly made an~ filed with ~he.City Clerk of the said ~Ity of Santa Aha, a complete list oi' all asses merits unpaid upon ~he said assessment, which list is now on rile in ~he office or the City Clerk of said ~ity; now upon evidence shown, this City Council determines ~hat ~he assessments =herein mentioned were ~hen unpaid, the to~al aggregate ~hereof oelng the sum of Fourteen Thousand Six Hundred Seventeen and 99/100 Dollars ($14,617.99), and ~hat no assessments have ~een paid since the filing o~ the llst of unpaid assessments oy the ~t~eet Superintendent, an~ ~hat there now remains unpaid ~he sum of Fourteen Thousand Six Hundred seventeen and 99/100 Dollars ($14,617.99), upon the assessments shown upon said ~is~. Reference is here~y made to Resolution of Intention No. 1~4~ o~ the City Council of the City of Santa Aha, pa~sed on the 14th day of November 192~, for a complete description of the work herein mentioned, and to the list of unpaid assessments filed as aoove s~a~ed rot ~he assessments unpaid; and ~tEEEAS, interested persons were notified in the manner required by law ~o appear oeI'ore ~he oity Council in the ~ouncil ~hamber or the ~ity Hall of said City at the hour of V:30 o'clock F.M. on Monday, the 6th day of August, 192~, and show cause, why bonds should not ~e issued upon the security of the unpaid assessments shown on the ~treet Superintenaent,s list; and ¥~EREAS, notice was duly given in the manner and form required by law, ~hat serial ~onds to represent unpaid assessments.bea~ing interest a~ the rate of six per cent per annum wili oe issued here'~n~er in the manner provided in the "Improvement ~ond Act of 19lb", the last ins~allmen~ or which bonds shall mat-are nine years from the 2nd day of July, next succeeaing ten (10) months from their da~e, and a±m interested persons having appeared before this City Counei± and having ~een given a full opportunity =o snow cause why bonds should no~ be issuea upon ~he security of the unpald assessments shown on sai~ list, and a~i oOJections p~esen~ed having ~een heard and consiGered. IT IS THEREFORE NOW BY THE CITY COUNCIL OF THE CITY OF SANTA ANA, DETEEMlm~10~ RESOLVED AND ORDERED AS FOLL0~S: That no cause has been shown why bonds should not be issued upon the security of said unpaid assessments, and does hereby overmale all objections thereto, and does hereby direct the issuanc~ 49
