RESOLUTION NO. 2039 <br /> <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA, CALIFOF~NIA, <br /> RELATING TO THE ISf~UANCE OF STRE]~;T IMPF, OVE. MENT BONDS, PURSUANT TO <br /> RESOLUTION OF INTENTION NO. 1915; DETERMINING THE AMOL~NT OF UNPAID <br /> ASSESSmeNTS, PRESCRIBING THE DENOMINATION OF SUCII BONDS; AND PROVIDING <br /> FOR THEIR ISSUANCE IN ANNUAL SERIES: <br /> <br /> WHEREAS, pursuant to Statute, n~ttce of filing of list of unpaid assessments <br /> was duly given in the manner and form required by law, that the warrant, assessment <br /> and diagram was recorded on the 2nd day of October, 1928, for the woPk and improvement <br /> made by Steele Finley, under that certain contract awarded to him on the 14th day of <br /> May, 1928, upon portions of Pacific Avenue, Fifth Street, Third Street, Second Street, <br /> First Street and Bristol Street; and that said warrant, assessment and diagram were <br /> returned to the Street Superintendent of said City, together with a written statement <br /> of all payments received upon the said assessment; and after the full expiration of <br /> thirty (30) days from the date of said warrant, the said Street Superintendent duly <br /> made and filed with the City Clerk of the said City of Santa Ana, a complete list of all <br /> assessments unpaid upon the said assessment, which list is now on file in the office <br /> of the City Clerk of the said City; now upon evidence shown, this City Council determine: <br /> that the assessments therein mentioned were then unpaid, the total aggregate thereof <br /> being the sum of Twelve Thousand Eight Hundred Thirty and 59/100 Dollars ($12,830.59), <br /> and that there have been paid since the filing of the list of unpaid assessments by the <br /> Street Superintendent the following assessments, to-wit: Assessment No. 40 for ~46.36; <br /> Assessment No. 73 for $417.?1 and Assessment No. 119 for $93.17, and there now remains <br /> unpaid the sum of Twelve Thousand Two Hundred Seventy-three and 35/100 Dollars <br /> ($12,273.35) upon th6 assessments shown upon said list. <br /> <br /> Reference is hereby made to Hesolutton of Intention No. 1915 of the City <br /> Council of the City of Santa Aha, passed on the 2nd day of April, 1928 for a complete <br /> description of the work l~erein mentioned, and to the list of unpaid assessments filed <br /> as above stated, for the assessments filed as above stated, for the assessments unpaid. <br /> <br /> AND, WHEMEAS, interested persons were notified in the manner required by law <br />to appesr before the City Council of the said City of Santa Ana, Calif~nia, in the <br />Council Chamber of the City Hall of said City at the hour of 7:30 o~c!ock P.M. on <br />Monday, the 19th day of November, 1928, and show cause why bonds should not be issued <br />upon the security of the unpaid assessments shown on the said Street SuperiDtendent's <br />list; and <br /> <br /> ~EREAS, notice was duly given, in the manner and form required by law, that <br />serial bonds to represent ~paid assessments bearing interest at the rate of six percent <br />per annum will be issued hereunder in the manner provided in the "Improvement Bond Act <br />Of 1915", the last installment of which bonds shall, mature nine (9) years frcm the 2nd <br />day of July, next succeeding ten months from their date, and all interested persons <br />having appeared before this City Council, and having~ been given full opportunity to <br />show cause why bonds should not be issued upon the security of the unpaid assessments <br />shown on said list, and all objections presented having been heard and considered; <br /> <br /> IT I~; THE~REFORE NO~.' BY THE. CITY COUNCIL OF THE CITY OF S^NTA ANA, DETERMINED, <br />RESOLVED AND ORDERED AS FOLLOW, S: <br /> <br /> That no cause has been shown why bonds should not be issued upon the security <br />of said unpaid assessments, and does hereby overrule all objections thereto, and does <br />hereby direct the issuance of said bonds; and further <br /> <br /> <br />
