RESOLUTION NO. 2224 <br /> <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITM OF SANTA ANA, <br /> CALIFORNIA, RELATING TO THE ISSUANCE OF STREET IMPROVE- <br /> MENT BONDS PURSUANT TO RESOLUTION OF INTENTION NO. 2177; <br /> DETERMINING THE AMOUNT OF UNPAID A$SESS~iENTS; PRESCRIBING <br /> THE DENOMINATION OF SAID BONDS AND PROVIDING FOR THEIR <br /> I~SUANCE IN ANNUAL SERIES: <br /> <br /> ~tEREAS, pursuant to statute n~tice of the filing of list of ttupaid assessment <br />was duly given in the manner and form required by law, that the warrant, assessment and <br />diagram was recorded on the 24th day of June, 1930, for the work and improvement made by <br />Calahan and McKee under that certain contract awarded to them on the 21st day of April, <br />1930, upon FairSawn street between Fifth Street and Eighth Street, and the Southerly <br />half of Eighth Street between Fairlawn Street and Artesia Street, as set forth in <br />Resolution of Intention No. 2177; and that said warrant, assessment and diagram were <br />returned to the Street Superintendent of said City together with a written statement of <br />all payments received upon the said assesmment; and after the full expiration of thirty <br />days after the date of recording of said warrant, the said Street Superintendent du~ <br />made and filed with the City Clerk of said City of Santa Aha, a complete list of all <br />assessments unpaid upon said assessment, which list is now on file in the office of the <br />City Clerk of said City; new upon evidence shown, the City Council determines that the <br />assessment therein mentioned were then unpaid, the total aggregate thereof being the sum <br />of Twenty-one Hundred Twenty-eight and 41/100 Dollars ($2,128.41), and that no assess- <br />ments have been paid since the f~ling of the list of unpaid assessments by the Street <br />Superintendent, and that there now remains unpaid the sum of Twenty~one Hundred Twenty- <br />eight and 41/100 Dollars ($2,128.41), upon the assessments shown upon said list. <br /> <br /> Reference is hereby made to Resolution of Intention No. 2177 of the City Counc~ <br />of the City of Santa Ana passed on the 17th day of March, 1930, for a complete descripti~ <br />of the work herein mentioned and to the list of unpaid assessments filed as above <br />state~ for the assessments unpaid; and~ <br /> <br /> W~EEEAS, interested persons were notified in the manner required by law te <br />appea~ before the City Council in the Council Chamber of the City Hall of said City at <br />~he he~ ef 7:30 o'clock P.M. on Monday, the llth day ef August, 1930, and show cause <br />why bonds should not be issued upon the security of the unpaid assessments shown on the <br />Street Superi~tendent's list; and <br /> <br /> WHEREAS, notice was duly given in the manner and foEmrequired by law that <br />serial bonds to represent unpaid assessments bearing interest at the rate of six pe~ <br />cent per annum will be issued hereunder in the manner provided in the Improvement Bond <br />Act of 1918, the last installment of which bonds shall mature nine yea~s from the 2nd <br />day of July next succeeding ten (10) months from their date; and all interested person. <br />having appeared before this City Council and having been given a full opportunity to sh~ <br />cause why bonds should not be issued upon the security of the unpaid assessments shown <br />on said list, and all objections presented having been heard and considered; <br /> <br /> IT IS THEREFORE NOW BM THE CITY COUNCIL OF THE CITY OF SANTA ANA, DETERMINED, <br />RESOLVED AND ORDERED AS FOLLOWS: That no cause has been shown why bonds should not be <br />issued upon the security of said unpaid assessments, and does hereby overrule all object. <br />ions thereto and does hereby direct the issuance of said bonds; and furthe~ <br /> <br /> BE IT RESOLVED AS FOLLOWS: That bonds shall be issued upon the security of <br />said unpaid assessments to said amount of Twenty-one Hundred Twenty-eight and 41/100 <br />Dollars ($2,128.41); <br /> <br />'S <br /> <br />~n <br /> <br /> <br />
