RESOLUTION NO. 2243 <br /> <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA, <br /> OALIFORNIA, RELATING TO THE ISSUanCE OF STRF1ET I~PROVE~,~NT <br /> BONDS PURSUANT TO RESOLUTION OF INTENTION NO. ~166; DETERmIN- <br /> ING THE AMOI~IT 0F UNPAID ASSESSMENTS; PRESCRIBING THE DENOM- <br /> INATION OF SUCH BONDS AND PROVIDING FOR THEIR ISSUANCE IN <br />ANNUAL SERIES. <br /> <br /> WHEREAS~ pursuant to State, notice of the filing of list of unpaid <br /> assessments wa~ duly given in the manner and for~ required by law, that the warran' <br /> assessment aud diagram was recorded on the 12th day of August, 1930, for the <br /> work and improvement made by Atkinson and Reish, under that certain contract <br /> awarded to them on the 10th day of ~arch, 1930, upon a portion of Lowell Street <br /> and a certain right~of-way, as set forth in Resolution of Intention No. 2188; and <br /> that said warrant, assessment and diagram were returned to the Street Superintend- <br /> ent of said City~ togethcr with a written statement of all payments received upon <br /> the said assessment; and after the full e~piration of thirty (S0) days after the <br /> date of recording of said warrant, the said Street Superintendent duly made and <br /> filed with the City Clork of said City of ~ anta Aha, a complete list of all <br /> assessments unpaid upon the said assessment, which list is now on file in the <br /> Office of the City Clerk of said City; now upon evidence shown, this City <br /> Council determine that the asses~ments therein mentioned were then unpaid, the <br /> total aggregate thereof being the sum of Seven Thousand, Six Hundred Twenty-two <br /> and ~9/100 Dollars (~,~2~.~9), and that no assessments have been paid since the <br /> filing Of the list of unpaid assessments by the Street Superintendent, and that <br /> there now remains unpaid the sum of Seven Thousand, Six Hun~lred Twenty-two and <br /> ~9/100 Dollars (~V,~2.~9) upon the assessments shown upon said list. <br /> <br /> Reference is hereby made to Resolution of Intention No. ~108 of the <br /> City Council of the City of Santa Ana, passed on the Srd day of February, 19S0, fo: <br /> a complete description of the work herein mentioned, and to the list of unpaid <br /> assessments filed as above stated for the assessments unpaid; and <br /> <br /> WHEREAS, interested persons were notified in the manner required by law <br />to appear before the City Council in the Council Chamber of the City Hall of said <br />City at the hour of ~:30 o~clock P.M. on ~onday, the 29th day of September, 1930~ <br />and show cause, why bonds should not be issued upon the security of the unpaid <br />assessments shown on the Street Superintendent's list; and <br /> <br /> WHEREAS, notice was duly given in the manner and form required by law~ <br />that serial bonds to z~p~esent unpaid assessments bearing interest at the rate of <br />six percent per annum will be issued hereunder in the manner provided in the <br />"Improvement Bond Act of 191§", the last installment of which bonds shall mature <br />nine years from the ~nd day of July, next succeeding ten (10) months from their <br />date, and all interested persons having appeared befor® thi~ City Council and <br />having been given a full opportunity to show cause why bonds should not be issued <br />upon the security of the unpaid assessments shown on said list, and all objectionm <br />~>resented having been heard and considered. <br /> <br /> IT IS THEREFORE NOW BY THE CITY COUNCIL OF THE CITY OF SANTA ANA~ <br />DE~ERNINED~ RESOLVED AND ORDERED AS FOLLOWS: That no cause has been shown why bcn~ <br />should not be issued upon the security of said unpaid assessments, and does hereby <br />overrule all objections thereto, and does hereby direct the issuance of said bonds <br />and further <br /> <br /> <br />
