RESOEUTION NO. 2595

<br />WHEREAS, ELMER B. CUBBON, has agreed to purchase from the City of Santa
<br />
<br />Ana Lot 4 of "Tract No. 488", excepting the portions thereof hereinafter
<br />
<br />described, on c6ndition that said City of Santa Aha, construct and maintain a
<br />
<br />surface water drainage ditch, as h~reinafter described, and,
<br />
<br />WHEREAS, it is necessary and desirable for the City of Santa Ana to
<br />
<br />construct and maintain the said drainage ditch in order to provide an outlet for
<br />
<br />the disposal of Certain surface and subsurface water from said City,
<br />
<br />NOW, THEREFORE, in consideration of the premises, be it resolved as
<br />
<br />follows:
<br />
<br />RESOLVED, that the City of Santa Ana mhall construct and maintain a
<br />
<br />drainage ditch in and upon the parcels of land described as follows:
<br />
<br />Parcel 1. The Westerly 30 feet of Lot Four (4) of "Tract
<br />No. 488", as shown on a Map recorded in Book 1V, page 4 of
<br />Miscellaneous Maps, records of Orange County, California,
<br />the Easterly 100 feet of the Southerly 65 feet of said Lot
<br />Four (4) of "Tract No. 488", as shown on a Map recorded in
<br />Book 17, page 4 of Miscellaneous Maps, records of Orange
<br />County, California, the Southerly 35 feet of that portion
<br />of said Lot Four (4) not hereinabove excepted, and the South
<br />30 feet of the North 42 fe~t of the West 160 feet of said lot
<br />foLtr~4), excepting the West 30 feet thereof.

<br />Parcel 2. Beginning at the North-west corner of Lot Eleven
<br />(ll) of "Plaza Rancho", as shown on a Map recorded in Book 2,
<br />page 13 of Miscellaneous Maps, records of Orange County,
<br />California, running thence Southerly along the Westerly line
<br />of said Lot Eleven (ll) and the Southerly sxtension thereof
<br />to the North-west corner of Lot Twelve (12) of said Plaza
<br />Rancho; thence Southerly along the Westerly line of Lot
<br />Twelve (12) to the Northerly line of Monta Vista Avenue, as
<br />shown on the Map of Santa Aha Acres, recorded in Book 4,
<br />page 77 of Miscellaneous Maps, records of Orange County,
<br />California; thence Easterly along the Northerly line of Monta
<br />Vista Avenue to a point 30 feet East of the South-west corner
<br />of Lot Ten (10) of said Plaza Rancho; thence Northerly along
<br />a line parallel to the Westerly line of said Lot Ten, 20 feet;
<br />thence Westerly along a line parallel~to the Northerly line
<br />of Monta Vista Avenue to a point 42 feet Easterly of the
<br />Westerly line of said Lot Twelve (12); thence Northerly alon~
<br />a line parallel to the Westerly line of said Lots Eleven (11)
<br />and Twelve (12) to a point in the Northerly line of said Lot
<br />Eleven, 42 feet Easterly from the North-west corner of said
<br />Lot Eleven (11); thence Westerly along the Northerly line of
<br />said Lot Eleven, 42 fe~t to the point of beginning;

<br />THAT said drainage ditch shall be connected at its southerly end, above
<br />
<br />described, with the Delhi Drainage District canal on the south side of Monta
<br />
<br />Vista Avenue opposite the southerly end of the above described drainage ditch,
<br />
<br />and said drainage ditch shall be constructed and maintained of sufficient depth
<br />
<br />to carry surface water away frc~ said premises and sufficient in size to carry
<br />
<br />ordinary flood waters to the drainage canal at its southerly end, but of no
<br />
<br />greater capacity than such drainage canal at said point; that said drainage ditch
<br />
<br />shall be constructed and completed not later than November l, 1938.
<br />
<br />The City of Santa Aha reserves the right, at any time, to provide
<br />
<br />other or ;different means of disposing of the surface or flood waters cared for
<br />
<br />by said ditch.

<br />PASSED AND ADOPTED by the City Council of the City of Santa Ana, at its
<br />
<br />regular meeting held on the 19th day of September, 1938.
