An Ordinance establishing a Recreation Department for the City of ,Santa And under management of a Rec-
<br /> reation Commission consisting of seven members; prescribing the manner of appointment of said
<br /> members; prescribing the management and supervision of public recreation; prescribing the acquisition
<br /> of and establishing playground areas, buildings and athletic fields; establishing a recreation fund and
<br /> levying of a tax therefor.
<br />
<br />The People o] the City of Santa Aha do ordain as follows:
<br />
<br /> Section 1: That a Recreation Department under the management of a Recreation Commission consisting of seven
<br />(7) members, not more than five (5) of whom shall be of the same sex, is hereby established for the City of Santa And.
<br />
<br /> Section 2: All members of the Recreation Commission shall serve without compensation. Three (3) members at
<br />large shall be appointed by the Mayor; two of the members shall be appointed by the City Council; and two shall be
<br />appointed by the Board of Education. Members of the Commission shall serve for a term of four (4) years or until
<br />their successors are appointed. Members of the Commission first appointed shall determine their respective terms of
<br />office by lot so that two members thereof shall serve for a term of two (2) years; two members thereof for a term of
<br />three (3) years; and three members thereof for a term of four (4) years. All vacancies shall be filled for the unexpired
<br />terms of the members whose office is vacant in the same manner as such member received original appointment.
<br />
<br /> Section 3: Wherever the "Commission" is hereinafter used, unless it is otherwise expressly specified, it shall be
<br />understood to refer to and mean the Recreation Commission, as in this article constituted.
<br />
<br /> Section 4: The Commission shall elect one of its members as President, who shall hold office for one (1) year and
<br />until his successor is elected. The Commission shall have the power to appoint a general manager, who shall be known
<br />as the Superintendent of the Recreation Department, and the Superintendent shall act as Secretary of the Commission.
<br />The Commission must hold regular meetings at least once every month, and shall establish such rules and regulations as
<br />it deems necessary for its government and for the faithful performance of its duties and which shall not be inconsistent
<br />with the laws of the State of California. It shall provide for and do any other acts which may be found necessary and
<br />proper by it to carry out the provisions and purposes hereof and to execute the duties imposed upon it under the pro-
<br />visions of this ordinance.
<br />
<br /> Section 5: The Superintendent shall manage and supervise the public recreation of the City within or without its
<br />corporate limits; shall aid and promote and supervise all public functions of a public recreational nature or character;
<br />shall, subject to the approval of the Recreation Commission by order entered on its minutes, have charge of the construc-
<br />tion, operation, sale, renting or leasing of all concessions or privileges on playground and public recreation areas, and
<br />shall have exclusive supervision and control of all equipment, apparatus, buili:lings, portions of buildings, public recrea-
<br />tion areas in parks and playgrounds devoted to public recreation; shall issue permits for the use of playgrounds and
<br />other public recreation areas, equipment and facilities; and shall, subject to the approval of the RecreAtion Commission
<br />by order entered on its minutes, adopt a schedule of charges and fees and rents for special or regular services and use
<br />thereof.
<br />
<br /> The Superintendent, with the approval of the Commission, shall appoint or discharge such supervisors, assistants
<br />and other employees as shall be necessary, and shall have the power to purchase such supplies and apparatus as may be
<br />necessary for properly carrying on their recreational activities.
<br />
<br /> Section 6: The term "public recreation" wherever herein used is hereby defined and understood to mean and in.
<br />clude all public recreational activities in or upon playgrounds, athletic fields, ball parks, summer camps, recreation cen-
<br />ters, swimming pools, beaches, streets, water fronts, waterways, public buildings, coliseums, play areas in parks, tennis
<br />courts and other suitable places or other public lands or public waterways used, owned, controlled or operated by the
<br />City of Santa And, either within or without its corporate limits, and the activities in or upon them, and the use of same
<br />for athletic sports, or contests, games, aquatic games, community leagues, pageants, dramatics, music, public amusements
<br />and other recreational and play programs or activities, whether herein specified or not, and the provisions of this article
<br />shall apply to adults as well as to minors.
<br />
<br /> Section 7: The City Council of Santa Ana shall have the power by ordinance to set aside, either absolutely or for
<br />a definite period of time, any lands, waterways or buildings, equipment or facilities belonging to it for public recreation
<br />under the jurisdiction of the Recreation Commission, and the same shall, when and so long as used by the Commission,
<br />be under its exclusive jurisdiction and control.
<br />
<br /> Section 8: The Commission may recommend to the City Council the acquisition of lands or waterways, buildings,
<br />structures or other equipment and facilities for public recreation as it may from time to time deem necessary for the proper
<br />conduct of'public recration as in this article defined. It shall have exclusive jurisdiction and control of the operation and
<br />~lUblic rec~tional activities. The Com~xission s~]~r pass upon and approve a pans or the improveme~
<br /> ic recreati06 ~nd ior the erection, construction or improvement of buildings or other equipment, struc-
<br />tures and facilities for the purpose of public recreation.
<br />
<br /> Section 9: The City Council of Santa Ana shall establish a fund to be known as the "Recreation Fund". There
<br />shall be deposited to and expended from this fund all fees or moneys received by the Commission, ine!uding the proceeds
<br />from all gifts, legacies or bequests or other sources managed or controlled by the Commission and derived by it in con-
<br />nection with the operation of the public recreational activities and facilities under its jurisdiction. All moneys in said fund
<br />shall be used for the promotion, supervision and operation of public recreation, as in this article defined, and not other-
<br />wise, and if not used during any current year shall accumulate in said "Recreation Fund".
<br />
<br /> Section 10: The City Council of Santa Aha shall annually levy and collect on all the taxable property in the City
<br />of Santa Ana, for the purpose of creating a special fund to be designated as "Recreation Fund", not less than one (1)
<br />mill on each dollar of the value on all real and personal property of the City, as assessed by the City for City purposes,
<br />and, in addition thereto, shall have power to appropriate such additional funds as it may deem necessary and proper.
<br />Said fund shall be exclusively maintained and used to meet the legal demands and expenditures of the Commission
<br />made for supervision, promotion and operation of a recreational program, and for the purchase of playground equip.
<br />ment and supplies.
