An Ordinance establishing a Recreation Department for the City of Santa Arm under management of a Rec- <br /> reation Commission consisting of seven members; prescribing the manner of appointment of .said <br /> members; prescribing the management and supervision of public recreation; prescribing the acquisition <br /> of and establishing playground areas, buildings and athletic fields; establishing a recreation fund and <br /> levying of a tax therefor. <br /> <br /> Section I I: The Commission may, for and on behalf of the City of Santa Ana, receive legacies, gifts or bequests for <br />the purchase, maintenance or improvement of grounds, buildings, equipment or facilities for the purpose of public recre- <br />ation. All moneys received from such legacies, gifts or bequests shall, unless otherwise expressly provided by the terms <br />of said legacies, gifts or bequests, be deposited in the treasury of the City of Santa Aha in the "Recreation Fund", and the <br />same may be withdrawn therefrom and paid out only in the manner as is provided for the payment of moneys legally <br />appropriated for the supervision, promotion and operation of public recreation programs and purchase of playground <br />equipment and supplies. If the moneys derived from such gifts, legacies or bequests shall at any time exceed in amount <br />the sum necessary for the immediate expenditure for the ptuposes of public recreation, then the Commission may invest <br />all or a part of the same in interest bearing bonds of the United States of America or of the State of California, or of any <br />municipality or school district thereof. <br /> <br /> Section 12: The Commission shall make a report every three (3) months of the activities thereof to the City Coun- <br />cil and an annual report of the activities thereof to the City Council, which annual report shall be filed with the City <br />Clerk. <br /> <br /> Section 13: If any section, subsection, ,clause or phrase of this ordinance is for any reason held to be unconstitu- <br />tional, such decision shall not affect the validity of the remaining sections of this ordinance. <br /> <br /> Section 14: Any provisions or clauses of the several ordinances of the City of Santa Ana in conflict herewith are <br />hereby expressly repealed. <br /> <br /> <br />
