RESOLUTION NO. 3~00 .., <br /> <br />A RESOLUTION OF THE CITY COUNCIL REJECTING <br />THE PROPOSED VACATION OF A PORTION OF WEST <br />FIFTEENTH STREET IN THE CITY OF SANTA ANA. <br /> <br /> WPrJEREAS, the City of Santa Ana on the 22nd day of July, 1946, <br /> <br />passed its certain Resolution No. 3482 , declaring its intention <br /> <br />to order the closing up, vacation and abandonment of a portion of West <br />Fifteenth Street in the City of Santa Aha, pursuant to and in accordance <br />with the provisions of the Street Vacation Act of 1941, approved May lZ, <br />1941, Statutes of 1941, Chapter 250 and amendments thereto, being Divis- <br />ion 9, Part 3, Streets and Highway Code; and <br /> WHEREAS, notices have been posted along the street proposed to be <br />vacated and copies of said resolution have been published, all as re- <br />quired by law, and as will more fully appear upon the affidavits of post- <br />ing and publication on file in the office of the City Clerk; and <br /> WHEREAS, the City Council by Resolution No. . 3482 aforesaid, <br />had fixed Monday, the 19th day of August, 1946, at 7:30 P. M. in the <br />Council Chambers, in the City Hall, Santa Aha, California, as the time <br />and place for hearing all persons interested in or objecting to the <br />proposed vacation of said street; and said matter having been heard in <br />part on said date and thereafter continued to September ~rd, 1946 for <br />further hearing, and thereafter continued to September 16th, 1946, for <br />further hearing thereon; and <br /> <br /> WHEREAS, the City Council has heard the evidence, both written <br /> and verbal, by all persons interested in the vacation of said street, <br /> and it appearing that a majority of th~ property owners affected by <br /> the closing of the portion of Fifteenth Street described in said Reso- <br /> lution and hereinafter described, have filed a written protest against <br /> the said vacation, unless they are furnished with a street outlet <br /> bo Washington Street, along the Westerly boundary of the school dis- <br /> trict property, and it further appearing that the Santa Aha City <br /> Board of Education has failed to take any action to provide such street <br /> outlet, therefore the City Council finds from all the evidence sub- <br /> mitted that the greater public interest and convenience does not re- <br /> <br /> <br />
