Upon implementation of GPU PEIR MM CUL-7, <br />impacts related to archaeological resources would be less than significant. <br />As discussed above, the Project Site is located in an urbanized area and most of the site has <br />been previously graded and developed. Therefore, the potential for uncovering human remains <br />on the Project Site is low. Therefore, similar to the conclusion in the GPU PEIR, compliance with <br />California Health and Safety Code Section 7050.5 (RR CUL-1) and Public Resources Code <br />Section 5097.98 would ensure that Project impacts to human remains would be less than <br />significant. <br />Based on the above, the Project would not result in new or substantially more severe impacts <br />compared to the determinations of the GPU PEIR, which concluded that impacts to historical <br />resources would be significant and unavoidable and impacts to archaeological resources and <br />human remains would be less than significant. Therefore, no new project -specific mitigation <br />measures are required. <br />4.5.3 Conclusion <br />The Project is consistent with the General Plan Update. With implementation of RR CUL-1 and <br />Mitigation Measure CUL-7, the proposed Project would not have any specific effects which are <br />peculiar to the Project or the Project Site. There are no project -specific impacts or potentially <br />significant off -site or cumulative impacts that the GPU PEIR did not analyze, and there are no <br />new significant or substantially more severe cultural resource impacts than anticipated by the <br />GPU PEIR. <br />4.5.4 Applicable GPU PEIR Regulatory Requirements/Mitigation Measures: <br />RR CUL-1 California Health and Safety Code Section 7050.5 requires that if human remains <br />are discovered within the proposed project site, disturbance of the site shall halt <br />and remain halted until the coroner has investigated the circumstances, manner, <br />and cause of any death, and the recommendations concerning the treatment and <br />disposition of the human remains have been made to the person responsible for <br />the excavation, or to his or her authorized representative. If the coroner determines <br />that the remains are not subject to his or her authority and if the coroner recognizes <br />or has reason to believe the human remains to be those of a Native American, he <br />or she shall contact, by telephone within 24 hours, the Native American Heritage <br />Commission. <br />MM CUL-4" For projects with ground disturbance—e.g., grading, excavation, trenching, boring, <br />or demolition that extend below the current grade —prior to issuance of any permits <br />required to conduct ground -disturbing activities, the City shall require an <br />Archaeological Resources Assessment be conducted under the supervision of an <br />archaeologist that meets the Secretary of the Interior's Professionally Qualified <br />Standards in either prehistoric or historic archaeology. <br />Assessments shall include a California Historical Resources Information System <br />records search at the South Central Coastal Information Center and of the Sacred <br />Land Files maintained by the Native American Heritage Commission.
