ADOPT -A -PARK AGREEMENT BETWEEN THE CITY OF SANTA ANA, THE <br />FLORAL PARK NEIGHBORHOOD AND THE GARDEN CLUB <br />FOR THE RENOVATION OF SARAH MAY DOWNIE PARK SITE <br />THIS AGREEMENT, made and entered into this day of <br />VO4&_-14- 1 1996, by and between the City of Santa Ana, a <br />municipal corporation of the State of California, hereinafter <br />referred to as the "CITY", and the Floral Park Neighborhood and <br />the Garden Club, community volunteer organizations, hereinafter <br />referred to as the "PARK RENOVATION COMMITTEE," <br />W I T N E S S E T H <br />RECITALS: <br />A. CITY owns and maintains for the publics benefit a small <br />herb garden, known as Sarah May Downie Park, at Flower Street and <br />North Park Boulevard in the City of Santa Ana, (hereinafter <br />referred to as "Park"). <br />B. The PARK RENOVATION COMMITTEE desires to enter into an <br />Adopt -A -Park agreement with the CITY for the sole purpose of <br />renovating the PARK. <br />C. The PARK RENOVATION COMMITTEE fully understands that <br />city funds are not available to renovate the PARK and have <br />actively pursued funding through private donations and fund <br />raising events. <br />D. The PARK RENOVATION COMMITTEE, through the various fund <br />raising events have raised approximately $10,000 for this project <br />and will continue to raise additional funding to complete the <br />renovation of the PARK site. <br />WHEREFORE, for and in consideration of their mutual <br />covenants and agreements hereinafter set forth, and subject to <br />the terms, condition, limitations and other provisions of this <br />agreement, hereinafter set forth, the parties agree as follows: <br />monlonsin <br />CITY shall review conceptual plans for the park improvements <br />prepared by the PARK RENOVATION COMMITTEE, make appropriate <br />recommendations to reduce liability and maintenance, and address <br />any Americans with Disabilities (ADA) requirements and building <br />code requirements. <br />CITY shall prepare construction drawings for the park <br />improvements based on the approved conceptual plans and submit <br />1 <br />
