individuals, males or females, shall in all instances be assumed as though in each case fully. <br />expressed. <br />The captions, section numbers, article numbers and table of contents appearing in this lease are <br />inserted only as a matter of convenience and in no way define, limit, construe or describe the scope <br />of intent of such sections or articles of this lease nor in any way affect this lease. <br />This lease and the Exhibits (and Riders and Addenda, if any) attached hereto and forming apart <br />hereof, set forth all the covenants, promises, agreements, conditions and understandings between <br />Neer and Tenant concerning the Premises, and there are no covenants, promises, agreements, condi- <br />tions or understandings, either oral or written, between them otber than are herein set forth. <br />Except as otherwise provided in this Lease, no subsequent alteration, amendment, change or addition <br />to this Lease shall be binding unless it is in writing and signed by Owner and Tenant. <br />ARTICLE 40. = OF THE ESSENCE. <br />Time is of the essence of this Lease and each and every provision hereof. <br />ARTICLE 41. EXECt71`IDN AND EMMIN+'r'TON OF LEASE. <br />TUS Tease may be executed in two or more counterparts, each of which shall be deemed an original <br />but all of which together shall constitute one and the same instrument. However, in the event of <br />any variation or discrepancy between fully executed copies of this Lease (inc11id ,any Addenda, <br />Exhibits and Riders), Owners copy shall control. Submission by Omer of this instrment for <br />examination or signature by Tenant does not constitute a reservation of the Premises or an option to <br />lease same from Owner, and this instrument is not effective as a lease or otherwise until execution <br />acid delivery by both Owner and Tenant. <br />ARTICLE 42. ODVENANT OF QUIET EbII0I24 U- <br />Upon payment by Tenant of the rents herein provided, and upon the observance and performance of all <br />the covenants, terms and conditions on Tenant's part to be observed and performed, Tenant shall <br />peaceably hold the Premises for the term hereby demised without hindrance or interruption by caner <br />or any other person or persons lawfully or equitably claiming by, through or under the Owner, sub- <br />ject, nevertheless, to the terms and conditions of this lease. <br />MAR 1488 <br />-20- <br />
