The Modified Project would not result in any new or more severe significant <br />impacts than those identified in the GP EIR. <br />The GP EIR RRs HYD-1 through HYD-5 are not applicable to the Modified Project because the Modified <br />Project is not a development project. The Modified Project would not obstruct the City's ability to implement <br />applicable GP policies. <br />4.11 LAND USE AND PLANNING <br />According to Appendix G of the CEQA Guidelines, a project would normally have a significant effect on the <br />environment if the project would: <br />LU-1 Physically divide an established community? <br />LtT-? Cause a significant environmental impact due to a conflict with any Iand use plan, policy, or <br />regulation adopted for the purpose of avoiding or mitigating an environmental effect? <br />Summary of Impacts in the GP EIR <br />As discussed in Section 5.10, Land Use and Plannin.g, of the GP EIR, the Approved Project is intended to guide <br />growth and development (e.g., infill development, redevelopment, and revitalization/restoration) in the plan <br />area through the year 2045 and beyond. The changes in the land use designations that would occur with <br />implementation of the Approved Project would not result in the physical division of an established community <br />(GP EIR p. 5.10-17-5.10-19). The Approved Project would enhance the character of the city for existing <br />residents because no new roadways would bisect existing communities, associated street improvements would <br />serve the existing neighborhoods, the Approved Project encourages infill development, and established General <br />Plan policies. Therefore, the impacts would be less than significant. <br />A portion of the city is within the JW,, s safety compatibility Zone 6 and within the 60 dBA CNEL aircraft <br />operation noise contours, and a larger portion of the southeastern portion of the city is within Federal Aviation <br />Regulation Part 77 Obstruction Notification Area of JWA (GP EIR p. 5.10-19-5.10-20). Areas within an <br />AELUP and FAA Zones land use designations would remain., and no new or more intense development is <br />intended. Any project within an identified AELUP and FAA Zone would be required to comply with filing a <br />project for a consistency determination with the ALUC, FAA airspace protection regulations, and local <br />regulations. Furthermore, the Approved project would be consistent with goals of the Southern California <br />Association of Governments' RTP/SCS, and the Orange County Transportation Authority Congestion <br />Management Plan (GP EIR p. 5.10-20-26). The GP EIR concluded that the approved project would not <br />significantly conflict with any land use plan, policy, or regulation, and with implementation of GP policies and <br />RR LU-1, RR LU-2, and RR HAZ-7, impacts would be less than significant. <br />Analysis of the Modified Project <br />The Modified Project would expressly prohibit STRs and only affect existing structures. The Modified Project <br />would not require development, redevelopment, or changes to existing development types in the city. <br />Additionally, the existing conditions related to land use and planning have not changed since the certification <br />Resolution No. 2024-072 <br />Page 47 of 67 <br />
