movement,, nesting sites, and migratory birds protected under the Migratory Bird Treaty Act as well as state law. <br />However, with the implementation of MM B10-1 and applicable GP policies and compliance with RR B-2, the <br />GP EIR deterlymied that impacts would be less than significant. <br />The city is not within a Natural Community Conservation Planning (NCCP) or Habitat Conservation Plan <br />(HCP) (GP EIR p. 5.3-21). Future development would be required to adhere to local, State, and federal laws <br />and regulations governing the protection and preservation of wildlife, plants, and habitat. with adherence to <br />local., State, and federal laws and regulations and because the city is not within an adopted NCCP/HCP area, <br />impacts would be less than significant. <br />GP EIR Mitigation Measure 1310-1 is reproduced here. <br />1310-1 For development or redevelopment projects that would disturb vegetated land or major stream <br />and are subject to CEQA, a qualified biologist shall conduct an initial screening to determine <br />whether a site -specific biological resource report is warranted. If needed, a qualified biologist <br />shall conduct a field survey for the site and prepare a biological resource assessment for the <br />project, including an assessment of potential impacts to sensitive species, habitats, and <br />jurisdictional waters. The report shall recommend mitigation measures, as appropriate, to <br />avoid or limit potential biological resource impacts to less than significant. <br />Analysis of the Modified Project <br />The Modified Project would expressly prohibit STRs and only affect existing structures. The Modified Project <br />would not require development, redevelopment, or changes to existing development types in the city. <br />Additionally, the existing conditions related to biological resources have not changed since the certification of <br />the GP EIR. The Modified Project is not anticipated to result in physical impacts on the environment. No <br />impacts would occur. The Modified Project would not result in any new or more severe significant impacts than <br />those identified in the GP EIR. <br />GP EIR RR B-1 through RR B-5 are not applicable to the Modified Project because the Modified. Project does <br />not require construction. The Modified Project would not obstruct the City ability to implement applicable <br />GP policies. <br />It should be noted that GP EIR MM B10-1 is not applicable to the Modified Project because the Modified <br />Project is not a development project <br />4.5 CULTURAL RESOURCES <br />According to Appendix G of the CEQA, Guidelines, a project would normally have a significant effect on the <br />environment if the project would: <br />CUL-1 Cause a substantial adverse change in the significance of a historical resource pursuant to <br />Section 15064.5? <br />Ordinance NS-3072 <br />
