information including, but not <br />limited to, patents, trade <br />secrets, processing methods <br />or customer lists; or <br />(!I) The unauthorized use or <br />disclosure of confidential <br />information of another person <br />or entity which is held by you <br />including, but not limited to, <br />financial information, personal <br />information, credit card <br />information or similar non <br />public information. <br />(8) Welfare and Pension Plan ERISA <br />Compliance <br />(a) The "employee benefit plan" <br />(hereafter referred to as Plan) is <br />included as an insured under this <br />Additional Coverage. <br />(b) If any Plan is insured jointly with <br />any other entity under this <br />Additional Coverage, you or the <br />Plan Administrator must select a <br />Limit of Insurance for this <br />Additional Coverage that is <br />sufficient to provide a Limit of <br />Insurance for each Plan that is at <br />least equal to that required if each <br />Plan were separately insured. <br />(c) With respect to loss sustained or <br />"discovered" by any such Plan, <br />paragraph (1) above, of this <br />Additional Coverage is replaced <br />by the following: <br />(1) We will pay for loss of or <br />damage to "funds" and "other <br />property" resulting directly <br />from fraudulent or dishonest <br />acts committed by an <br />"employee", whether identified <br />or not, acting alone or in <br />collusion with other persons. <br />(d) If the first Named Insured is an <br />entity other than a Plan, any <br />payment we make for loss <br />sustained by any Plan will be <br />made to the Plan sustaining the <br />loss. <br />(a) If two or more Plans are insured <br />under this Additional Coverage, <br />any payment we make for loss: <br />(1) Sustained by two or more <br />Plans; or <br />(it) Of commingled "funds" or <br />"other property' of two or <br />more Plans; <br />Resulting from an occurrence, will <br />be made to each Plan sustaining <br />loss in the proportion that the Limit <br />of Insurance required for each <br />Plan bears to the total Limit of <br />Insurance of all Plans sustaining <br />loss. <br />(f) The deductible does not apply to <br />this Additional Coverage. <br />q. Rewards — Arson, Theft and Vandalism <br />(1) We will reimburse you for payment of <br />any reward offered on your behalf and <br />for information that leads to the arrest <br />and conviction of the person or <br />persons responsible for: <br />(a) Arson; <br />(b) "Theft"' or <br />(c) Vandalism <br />to Covered Property. <br />(2) The arrest or conviction must involve <br />a covered loss caused by arson, <br />"theft" or vandalism. <br />(3) The most we will pay under this <br />Additional Coverage is $10,000 unless <br />a higher Limit of Insurance is shown in <br />the Additional Property Coverage <br />Schedule. The amount we pay is not <br />increased by the number of persons <br />involved in providing the information. <br />(4) The amount payable under this <br />Additional Coverage is additional <br />insurance. <br />(5) The deductible does not apply to this <br />Additional Coverage. <br />r. Computer Equipment <br />(1) We will pay for direct physical loss of <br />or damage to the following Covered <br />Property which is your property or <br />property in your care, custody or <br />control while at or away from the <br />described premises when loss or <br />damage is caused by or resulting from <br />a Covered Cause of Loss: <br />(a) "Computer equipment"; and <br />(b) Programming documentation and <br />instruction manuals. <br />(2) We will pay for the actual loss of <br />Business Income you sustain as <br />described in the Business Income <br />Additional Coverage and we will pay <br />for any necessary Extra Expense you <br />incur during the "period of restoration" <br />391-1003 08 16 Includes copyrighted material of Insurance Services Office, Inc., with its permission.
