b. The unusual or rapid accumulation of
<br />runoff of surface waters from any source;
<br />c. Mudslides or mudflows which are caused
<br />by "flood" water. A mudslide or mudflow
<br />involves a river of liquid and flowing mud
<br />on the surface of normally dry land areas
<br />as when earth is carried by a current of
<br />water and deposited along the path of the
<br />current.
<br />d. The release of water impounded by a
<br />dam, levee, dike, seawall or "flood" control
<br />device, whether driven by wind or not
<br />(including storm surge).
<br />When a "flood" is a continuous or
<br />protracted event it will constitute a single
<br />"flood" occurrence.
<br />24. "Forgery" means the signing of the name of
<br />another person or organization with intent to
<br />deceive; it does not mean a signature which
<br />consists in whole or in part of one's own name 29
<br />signed with or without authority, in any
<br />capacity, for any purpose.
<br />25. "Fraudulent instruction" means:
<br />a. An electronic, telegraphic, cable, teletype,
<br />tele facsimile or telephone instruction
<br />which purports to have been transmitted
<br />by you, but which was in fact fraudulently
<br />transmitted by someone else without your
<br />knowledge or consent;
<br />b. A written instruction (other than those
<br />described in SECTION I — PROPERTY, A.
<br />Coverage, 5. Additional Coverages, It.
<br />Forgery or Alteration) issued by you,
<br />which was forged or altered by someone
<br />other than you without your knowledge or
<br />consent or which purports to have been
<br />issued by you, but was in fact fraudulently
<br />issued without your knowledge or consent.
<br />26. "Funds" means "money" and "securities".
<br />27. "Fungi" means any type or form of fungus,
<br />including mold or mildew, and any mycotoxins,
<br />spores, scents or by-products produced or
<br />released by "fungi".
<br />28. "Hardware" means a network of electronic
<br />machine components (microprocessors)
<br />capable of accepting instructions and
<br />information, processing the information
<br />according the instructions, and producing
<br />desired results. "Hardware" includes but is not
<br />limited to:
<br />a. Mainframe and mid -range computers and
<br />servers;
<br />c. Portable electronic devices. Portable
<br />electronic devices include laptops, tablets,
<br />e-readers, smartphones or other
<br />lightweight, hand-held or wearable
<br />devices capable of storing, retrieving and
<br />processing data; and
<br />d. Peripheral data processing equipment,
<br />including but not limited to printers,
<br />keyboards, monitors, and modems.
<br />"Hardware" does not mean electronic items
<br />that are not similar to the items listed in a., b.,
<br />c. and A. above. "Hardware" does not include:
<br />e. Diagnostic equipment;
<br />If. Electronic items that contain a computer to
<br />perform functions other than "hardware";
<br />and
<br />g. Peripheral data processing equipment
<br />valued more than the "hardware" itself.
<br />"Hazardous substance" means any substance
<br />that is hazardous to health or has been
<br />declared to be hazardous to health by a
<br />governmental agency.
<br />30. "In transit" means in the course of shipment
<br />from or to the premises shown in the
<br />Declarations. It includes such shipments while
<br />temporarily stopped or delayed, incidental to
<br />the delivery.
<br />31. "Manager" or "managers" means a person or
<br />persons serving in a directorial capacity for a
<br />limited liability company (LLC).
<br />32. "Media" means an instrument that is used with
<br />"hardware" and on which "electronic data",
<br />"programs and applications", and "proprietary
<br />programs" can be recorded or stored. "Media"
<br />includes, but is not limited to, films, tapes,
<br />cards, discs, drums, cartridges, cells, DVDs,
<br />CD-ROMs and other portable data devices.
<br />33. "Member" or "Members" means an owner of a
<br />limited liability company represented by its
<br />membership interest, who also may serve as a
<br />"manager".
<br />34. "Messenger" means you, or a relative of
<br />yours, or any of your partners or "members",
<br />or any "employee" while having care and
<br />custody of property away from the described
<br />premises.
<br />35. "Money" means:
<br />a. Currency, coins and bank notes in current
<br />use and having a face value;
<br />b. Traveler's checks and money orders held
<br />for sale to the public; and
<br />b. Personal computers and workstations; C. In addition, includes:
