sanitary sewer system, if the breakage
<br />or cracking is caused by wear or tear.
<br />But water damage does not include loss or
<br />damage otherwise excluded in SECTION I
<br />— PROPERTY, B. Exclusions, paragraph
<br />1. g. Water.. Therefore, for example, there
<br />is no coverage in the situation in which
<br />discharge or leakage of water results from
<br />breaking apart of cracking of a pipe which
<br />was caused by or related to weather -
<br />induced "flood" water, even if wear and
<br />tear contributed to the breakage or
<br />cracking. As another example, and also in
<br />accordance with the terms of the Water
<br />Exclusion, there is no coverage for loss or
<br />damage caused by or related to weather -
<br />induced "flood" water which follows or is
<br />exacerbated by pipe breakage or cracking
<br />attributable to wear and tear.
<br />To the extent that accidental discharge or
<br />leakage of water falls within the criteria set
<br />forth in paragraphs (1) or (2) above of this
<br />definition of "specified causes of loss",
<br />such water is not subject to the provisions
<br />of SECTION I — PROPERTY, B.
<br />Exclusions, paragraph 1., g. Water,
<br />which preclude coverage for surface water
<br />or water under the ground surface.
<br />51. "Stock" means merchandise held in storage or
<br />for sale, raw materials and in process or
<br />finished goods, including supplies used in their
<br />packing or shipping.
<br />52. "Suspension" means:
<br />a. The partial slowdown or complete
<br />cessation of your business activities; or
<br />b. Part or all of the described premises is
<br />rendered untenantable, if coverage for
<br />Business Income applies.
<br />53. "Telephonic services" means use of your:
<br />a. Telephone services;
<br />b. Telephone credit cards; or
<br />c. Telephone access cards.
<br />54. "Theft" means the unlawful taking of property
<br />to the deprivation of the Insured.
<br />55."Transfer account" means an account
<br />maintained by you at a financial institution
<br />from which you can initiate the transfer,
<br />payment or delivery of "money" and
<br />"securities" by means of:
<br />a. Electronic, telegraphic, cable, teletype,
<br />telefacsimile or telephone instructions
<br />communicated directly through an
<br />electronic funds transfer system; or
<br />b. Written instructions (other than those
<br />described in SECTION I — PROPERTY, A.
<br />Coverage, 5. Additional Coverages, k.
<br />Forgery or Alteration) establishing the
<br />conditions under which such transfers are
<br />to be initiated by such financial institution
<br />through an electronic funds transfer
<br />system.
<br />56. "Valuable papers and records" means:
<br />a. Inscribed, printed or written:
<br />(1) Documents;
<br />(2) Manuscripts; and
<br />(3) Records;
<br />including abstracts, books, deeds,
<br />drawings, films, maps or mortgages;
<br />b. If you are a Printer, Publisher or Graphic
<br />Artist by trade, "valuable papers and
<br />records" means negatives, positives,
<br />artwork, separations, plates, dies, molds,
<br />forms, stock manuscripts and other similar
<br />property usual to the graphic arts, printing
<br />or publishing industry, including those
<br />which exist on electronic or magnetic
<br />"media", other than prepackaged software
<br />programs.
<br />But "valuable papers and records" does not
<br />mean "money" or "securities".
<br />SECTION II — LIABILITY
<br />A. Coverages
<br />1. Business Liability
<br />a. We will pay those sums the insured
<br />becomes legally obligated to pay as
<br />damages because of "bodily injury",
<br />"property damage" or "personal and
<br />advertising injury" to which this insurance
<br />applies. We will have the right and duty to
<br />defend the insured against any "suit"
<br />seeking those damages. However, we will
<br />have no duty to defend the insured
<br />against any "suit" seeking damages for
<br />"bodily injury", "property damage" or
<br />"personal and advertising injury", to which
<br />this insurance does not apply. We may, at
<br />our discretion, investigate any
<br />"occurrence" or any offense and settle any
<br />claim or "suit" that may result. But:
<br />(1) The amount we will pay for damages
<br />is limited as described in SECTION II
<br />— LIABILITY, D — Liability and
<br />Medical Expenses Limits of
<br />Insurance;and
<br />(2) Our right and duty to defend end when
<br />we have used up the applicable Limit
<br />of Insurance in the payment of
