ATTACHMENT NO. 4 <br /> <br />SCOPE OF DEVELOPMENT <br /> <br />The Property to be acquired and developed by Redeveloper pursuant <br />to this Agreement is approximately 14 acres in total area. The <br />Property is generally bounded by Third Street on the north, Flower <br />Street on the west, First Street on the south, and Ross Street on <br />the east. <br /> <br />The Redeveloper shall construct on the Property a high density <br />residential development of high quality and an attractive living <br />environment including 199 units of senior-citizen, rent-subsidized <br />housing on the Phase I Parcel and approximately 316 housing units <br />for rent at market rates or a combination of market rates and sub- <br />sidized rates on the Phase II Parcel. The develOpment shall include <br />landscaped plazas and open space with leisure and recreational <br />facilities and off-street parking facilities. <br /> <br /> The Property is comprised of the Phase I Parcel and the Phase II <br /> Parcel. The first parcel to be conveyed by the Agency to the <br /> Redeveloper is designated on the Property Map as Phase I Parcel <br /> and includes those portions of Van Ness Avenue and Second Street <br /> to be vacated by the City of Santa Ana and all alleys situated <br /> therein. At the election of the Redeveloper, the Phase II Parcel <br /> may be divided into two or~ three subparcels to'permit incremental <br /> development on the Phase II Parcel. If the Redeveloper elects to <br /> divide such Phase II Parcel following conveyance of the Phase I <br /> Parcel,~ the Redeveloper shall notify the Agency, in writing, with- <br /> in 30 days after the date of conveyance of the Phase I Parcel. <br />In the event of such election, the size and configuration of the <br />proposed subparcels shall be subject to prior Agency approval, <br />which approval or disapprovaI shall be based, in part, on whether <br />or not the configuration of the firs~ subparcel to be con~eyed <br />results in a configuration of the remaining subparcel(s) which <br />is feasible for development in the event of default by the <br />.Redeveloper. <br /> <br /> In the event the Redeveloper elects to divide the Phase II Parcel <br /> into two subparcels the First Subparcel shall include not less than <br /> 218,281 square feet of contiguous area with frontage on at least two <br /> boundary streets and the development on such First Sub Parcel shall <br /> be developed with at least 145 dwelling units. In the event the <br /> developer elects to divide the Phase II Parcel into three subparcels <br /> the First Sub Parcel shall include not less than 145,520 square feet <br /> of contiguous area and be developed with at least 100 dwelling units <br /> and the Second Sub Parcel shall include not less than 145,520 square <br /> feet of contiguous area and be developed with at least 100 dwelling <br /> units. Upon written-request of the Redeveloper, the minimum require- <br /> ments for square footages to be acquired and developed and for units <br /> to be developed for the First and Second Sub Parcels may be adjusted <br /> at the discretion of the Executive Director of the Agency. <br /> <br />MAR 18 i 77 <br /> <br /> <br />
