(15) <br /> <br />The applicant shall implement a Transportation Demand Management Program, <br />approved by the City, to reduce morning peak-hour office trip-making by 15 percent. <br />The Phase ! Performance Requirement specifies that a.m. peak-hour project trips shall <br />not exceed 1,312 trips. With Phase Il, the project a.m. peak-hour trips shall not <br />exceed 2,306 trips. If the Performance Requirement is not met, even after a 180-day <br />period of implementation of contingency measures, a TDM penalty fee will be <br />imposed. The penalty fee is to be $889.00 per a.m. peak-hour trip exceeding the <br />Performance Requirement, subject to a maximum of $125,000 upon completion of <br />Phase I and $200,000 upon completion of Phase Il. Table 4-23 of the RDEIR shows <br />the project trip generation with the TDM included for both Phases I and Il.
