196 <br /> <br />Co <br /> <br />The project site is physically suitable for the type and density of <br />the proposed project. <br /> <br />Each proposed parcel site meets or exceeds the minimum <br />required street frontage for development within Specific <br />Development No. 43. The sizes of the proposed parcels permit <br />for development within the allowable square footage intensity <br />for MacArthur Place. There are no physical constraints on the <br />parcels to preclude development. <br /> <br />The design and improvements of the proposed project will not cause <br />substantial environmental damage or substantially and avoidably <br />injure fish and wildlife or their habitat. <br /> <br />No fish or wildlife will be affected by the approval of the map <br />or by the design and improvements of the project. <br />Environmental Review No. 98-175 has been prepared for the <br />project, pursuant to Title XIV, California Code of Regulations <br />§ 735.5(c) (1), after considering the record as a whole, there <br />is no evidence that the proposed project will have the <br />potential for any adverse effect on wildlife resources or the <br />habitat upon which the wildlife depends. Therefore, pursuant <br />to Fish and Game Code § 711.2 and Title XIV, CCR § 735.5(a) (3), <br />the payment of Fish and Game Department filing fees is not <br />required in conjunction with this project. <br /> <br />The design or improvements of the proposed project will not cause <br />serious public health problems. <br /> <br />The current and future development for this site will be in <br />compliance with Specific Development No. 43 and the Santa Aha <br />Municipal Code for such uses. <br /> <br />The design or improvements of the proposed project will not <br />conflict with easements necessary for public access through or use <br />of the property within the proposed project. <br /> <br />There are no easements that would affect the use or <br />development of these parcels. <br /> <br /> 2. Tentative Parcel Map No. 98-232 is hereby approved, as <br />conditioned in Attachment A, attached hereto and incorporated herein. <br /> <br />2 <br /> <br /> <br />
