Contamination includes any unclean, unsafe or unhealthful condition either actual <br />or potential, which arises out of the presence in the environment of any POLLU- <br />TANT, whether permanent or transient. <br /> <br />Environment includes land. bodies of water, underground water or water table or <br />aquifer, the atmosphere and any other natural feature of the earth, whether or not <br />altered, developed or cultivated. <br /> <br />Any loss, cost or expense arising out of any governmental directions or reduest <br />that the CITY test for, monitor, clean up, remove, contain, treat, detoxify or <br />neutralize POLLUTANTS. <br /> <br />Any CLAIM for past salary or wages due because of discrimination or because of <br />wrongful termination or violation of civil rights of any employee or official of the <br />CITY; <br /> <br />BODILY INJURY to: <br />a. An employee of the CITY arising out of and ir~ the course of employment by <br /> the CITY; or <br /> <br />b. The spouse, child, parent, brother or sister of that employee as a conse- <br /> quence of actions of the employee arising out of and in the course of his/her <br /> employment by the CITY. <br /> <br />This exclusion applies whether the CITY may be liable as an employer or in any <br />other capacity, except with respect to Liability of others assumed under contract; <br /> <br />Any obligation for which the CiTY or any insurance company as its insurer may be <br />held liable under any workers' compensation or disability benefits law or any <br />similar law; <br /> <br />Liability arising out of the ownership or operation of any hospitat or airport; <br /> <br />BODILY INJURY or PROPERTY DAMAGE arising out of or in connection with the <br />operation of any hospital, clinic, or established health care facilities owned or <br />operated by the CITY due to~ <br /> <br />1. The rendering of or failure to render <br /> <br /> A. Medical, surgical, dental, X-ray or nursing service or treatment, <br /> or the furnishing of food or beverages in connection therewith; <br /> <br /> B. Any service or treatment conductive to health, or of a profes- <br /> sional nature or; <br /> C. Any cosmetic or tonsorial service or treatment. <br />2. The furnishing of or dispensing of drugs or medical, dental, or surgical sup- <br /> plies or appliances. <br /> <br />This exclusion shall not apply, however, to BODILY INJURY or PROPERTY <br />DAMAGE arising out of the performance of occupational physical examinations. <br />paramedics services, emergency care, or T.B. testing clinics; <br /> <br />Liability arising our of the rupture, bursting, overflow, or release of water from any <br />dam(si, etc. <br /> <br />9.
