.B. <br /> <br />10. PROPERTY DAMAGE to: <br /> <br /> a. Property owned by the Insured; or <br /> <br /> b. Property rented to. leased or in the care, custody and control of the Insured <br /> where it has assumed the Liability for damage to or destruction of such prop- <br /> erty, unless the Insured would have been liable in the absence of such <br /> assumption of Liability; <br /> <br /> c. Watercraft exceeding 26 feet in length, in the CITY's care, custody or con- <br /> troJ; <br /> <br /> d. AIRCRAFT <br /> <br />Any Liability arising out of the ownership, operation, use or maintenance of any <br />AIRCRAFT; <br /> <br />12. <br /> <br />Any liability arising out of the operation of any transit authority, transit system, or <br />public t~ansportation system owned or operated by the Insured, except a transit <br />system operating over non-fixed route systems such as dial-a-ride, senior citizen <br />transpor[ation, or handicapped transportation; and <br /> <br />13. <br /> <br />Any Liability arising out of the failure to supply or provide an adequate supply of <br />gas, water or electricity when such failure is a result of the inadequacy of the In- <br />sured's facilities to supply or produce sufficient gas, water or electricity to meet <br />the reasonable demand. <br /> <br />14. <br /> <br />Any Liability arising out of, or in connection with the principles of eminent do- <br />main, condemnation proceedings or INVERSE CONDEMNATION by whatever <br />name called, and whether or not Liability accrues directly against the Insured by <br />virtue of any agreement entered into by or on behalf of the Insured. <br /> <br />This exclusion shall not apply to PROPERTY DAMAGE caused by the negligence <br />or other fault of the Insured even though a legal theory upon which a claimant <br />seeks recovery is the principle of INVERSE CONDEMNATION. <br /> <br />This agreement does not apply under Coverage C (PUBLIC OFFICIALS ERRORS AND <br />OMISSIONS): <br /> <br />1. BODILY INJURY; <br /> <br />2. PROPERTY DAMAGE; <br /> <br />3. PERSONAL INJURY; <br /> <br />Benefits payable under any employee benefit plan (whether the plan is negotia- <br />ted, or voluntarily established by the CITY or mandated by law because of unlaw- <br />ful discrimination; <br /> <br />5.
