<br />g. REMOVE GRAFFITI <br /> <br />"Graffiti" is defined as an inscription or drawing made on a public surface. <br />Graffiti found anywhere in the Area will be immediately removed, using proper <br />tools, rags, and Wipeout (by Chemsearch) graffiti remover, leaving surface in a <br />"like new" condition (see item c, CLEANING PARKING METERS, for special <br />conditions). Large amounts of graffiti needing more than routine cleaning must <br />be reported to City. <br /> <br />h. SPOT PAINT <br /> <br />Trash containers, meters, outdoor furniture, bollards, light poles shall be spot <br />painted, only with paint approved by City, on an as-needed basis. Trash <br />containers, meters, outdoor furniture, bollards, light poles needing more than <br />routine spot painting must be reported to City. <br /> <br />1. FIRST SA TURDA Y OPENINGS <br /> <br />In preparation for the 2nd Street Mall Art Opening on the first Saturday of each <br />month, special attention shall be given to Items 14.a through h in the area <br />delineated in Attachment D, Map 4. Extra trash receptacles shall be placed in this <br />area. All work in this area shall be completed by 2 p.m. Saturday. <br /> <br />15. Contractor shall provide a basis by which, in the event City requires a change in the <br />scope of services set out in this Agreement, for example, a reduction or addition of <br />facilities, or an increase or decrease in the tasks, or special cleaning requirements, such <br />changes in scope may be assumed (i.e on the basis of an hourly rate of charge for labor <br />and materials or on a unit price basis). Such rate of charge shall be in force during the <br />first year of the contract and shall be negotiated for the succeeding years in accordance <br />with the methods for changes set forth elsewhere in this agreement. <br /> <br />16. The City will give the Contractor written notice of work deficiencies by copies of <br />Inspection Reports prior to charging a liquidated damage fee. These Inspection Reports <br />shall be given to Contractor on a timely basis. <br /> <br />City will: <br /> <br />a. In the case of work scheduled for performance on a daily basis, deduct from the <br />Contractor's next invoice a fee of Ten Dollars ($10.00) per occurrence of each <br />task. <br /> <br />b. In the case of work scheduled for performance on less than a daily basis, allow the <br />Contractor to correct the deficiency without penalty during the next scheduled <br />work shift, or at a time mutually agreed, unless the work deficiency is a <br />continuation; then the provisions of (a) will apply. <br /> <br />Repeated instances of nonperformance by Contractor will be grounds for termination of <br />Contract by City. <br /> <br />6 <br />
