<br />notification. In the event such off-duty employee is on <br />stand-by status during any court session and is not <br />required to appear in court, such employees shall be <br />compensated two (2) hours on a straight time basis, for <br />each court session. Such employee may elect, in lieu <br />of paid time, two (2) hours of comp time off for <br />standby time and not appearing in court, with the <br />approval of the Police Chief. If such off-duty employee <br />on stand-by actually appears in court, he or she shall <br />be compensated as provided in Subsection A, supra. <br /> <br />C. Employees assigned to the 3/12.5 or 7/12.5 Work <br />Schedule who appear in court during their regularly <br />scheduled workweek, and as a result do not receive <br />adequate rest, will be allowed to flex their scheduled <br />shift start time up to four hours, with the approval of <br />the employee's immediate supervisor and watch <br />commander, or immediate supervisor and section <br />commander. Alternatively, the employee may be allowed <br />to use up to four hours from his/her "Time Off Bank" or <br />from compensatory time off at the beginning of their <br />scheduled shift to ensure adequate rest. <br /> <br />1. <br /> <br />An employee whose work shift <br />within thirty minutes of a <br />appearance shall be compensated <br />minutes at an overtime rate. <br /> <br />ends or <br />mandatory <br />for those <br /> <br />starts <br />court <br />thirty <br /> <br />D. Employees who are on call for court during off-duty <br />time, and who are called to testify, will be paid at <br />the overtime rate of time and a half of their regular <br />hourly rate, to include actual travel time from their <br />home to court and back, or until their regularly <br />scheduled shift begins. Travel time will be limited to <br />a maximum of one (1) hour each way. Only that period <br />of time devoted to work will be compensated. Time <br />spent on personal pursuits or other non-work related <br />activity will not be compensated. <br /> <br />E. Those employees who have advance notice of their <br />required appearance in court, have arranged an <br />appearance time with the District Attorney's Office, or <br />who otherwise have advance notice of mandatory court <br />appearances, will not be compensated for travel time in <br />any manner. <br /> <br />F. Employees who appear in court during off-duty hours may <br />elect to start their normal work shift early as <br />specified herein. <br /> <br />G. A subpoenaed employee scheduled to appear in court on <br />City business during off-duty time and placed on <br />standby status by the Police Chief or his authorized <br /> <br />35 <br />
