<br />time limits set forth above, the grievant's immediate <br />supervisor shall add his or her comments and any <br />justification he or she considers proper, sign it, and <br />forward it to his or her Battalion Chief without undue <br />delay or, in no case, more than 21 calendar days from <br />receipt of the grievance. <br /> <br />B. The Battalion Chief, after study of the case, shall <br />attach his or her decision and reasons therefore, and <br />return them to the employee within 21 calendar days <br />after receipt of the written grievance. <br /> <br />C. If no satisfactory settlement has been reached at the <br />Battalion Chief level, the employee may, within 21 <br />calendar days after receipt of the Battalion Chief's <br />decision and reason(s) therefore, carry the matter to <br />the Deputy Fire Chief. To do so, the employee shall <br />describe on separate correspondence, the reason why he <br />or she is not satisfied, and shall submit this, with <br />the original form through his or her immediate <br />supervisor and Battalion Chief to the Deputy Fire <br />Chief. Failure of the grievant to take this action <br />will constitute a waiver and bar to the grievance, and <br />the grievance will be considered settled on the basis <br />of the Battalion Chief's response. <br /> <br />D. The Deputy Fire Chief, after study of the case, shall <br />attach his or her decision and reasons therefore and <br />return it to the employee within 21 calendar days of <br />the time of the receipt of the written grievance. <br /> <br />E. If no satisfactory settlement has been reached at the <br />Deputy Fire Chief level, the grievant may, within 21 <br />calendar days after the grievant's case has been <br />presented to the Deputy Fire Chief, carry the matter <br />to the Fire Chief. To do so, the employee shall <br />describe on separate correspondence the reason why he <br />or she is not satisfied and shall forward it with the <br />original form, through channels, to the Fire Chief. <br />Failure of the grievant to take this action will <br />constitute a waiver and bar to the grievance, and the <br />grievance will be considered settled on the basis of <br />the Deputy Fire Chief's response. <br /> <br />F. If the grievant files a written grievance to the Fire <br />Chief in the manner and within the time limits <br />specified in "E" above, then a conference shall be <br />held at the request of the employee or the Fire Chief. <br /> <br />74 <br />
