<br />G. The Fire Chief shall inform the employee of his action <br />within 21 calendar days after receipt of the request <br />for resolution. The original of the grievance form <br />and the Chief's decision shall be filed in the <br />personnel records in City Hall as well as those of the <br />Department. <br /> <br />H. If no satisfactory resolution has been reached at the <br />departmental level, the employee may, within 21 <br />calendar days after being informed by the Fire Chief <br />of his or her decision on the matter, and the reasons <br />thereof, submit the grievance in writing to the City <br />Manager, or the Ci ty Manager's duly authori zed <br />representative, for determination. Failure of the <br />grievant to take this action will constitute a waiver <br />and bar to the grievance, and the grievance will be <br />considered settled on the basis of the Fire Chief's <br />response. <br /> <br />The City Manager, or the City Manager's duly <br />authorized representative, after a careful review, <br />shall render a final decision on the merits of the <br />grievance, in writing, and return it to the grievant <br />within 21 calendar days after receiving the grievance. <br />A copy of the written grievance to the City Manager or <br />the City Manager's duly authorized representative, and <br />of the City Manager's or the City Manager's <br />representative's written decision, shall be filed in <br />the personnel records of the Department and the <br />grievant's personnel jacket maintained in the <br />Personnel Services Department. <br /> <br />Note: In the case of an alleged illegal discrimination <br />and/or harassment at any level of grievance, the <br />required time to respond to a grievance by the City <br />shall be adjusted by the City to include the time <br />required to conduct an internal review, but not to <br />exceed six months. <br /> <br />I. In unusual circumstances, an employee may petition the <br />Fire Chief directly to hear said grievance.
