Lighting Improvements <br />La Veta Avenue Bridge <br />April 3, 2006 <br />Page 2 <br />on Bristol Street/ <br />Over The I-5 Freeway <br />The Notice Inviting Bids was advertised on January 18 and 20, 2006, and <br />bids were opened on February 16, 2006. A summary of the bid invitations <br />mailed, the bids received, and the bid results follows. <br />Santa Ana Contractors receiving notices: <br />Contractors requesting bidding documents: <br />Bids received: <br />Bids received from Santa Ana Contractors: <br />NAME OF BIDDER <br />0 <br />5 <br />3 <br />0 <br />CITY <br />BID AMOUNT <br />1. Moore Electrical Contracting, Inc. Corona $223,121 <br />2. Mel Smith Electric, Inc. Stanton $294,700 <br />A total of three bids were received and two were responsive. Oak <br />Engineering, Inc. does not possess the proper contractors' license and <br />failed to notarize their bidder's signature on the bid bond as required <br />by the bidding documents. <br />The bidding document stipulates that the successful bidder must possess <br />or obtain a Class C-10, Specialty Electrical Contractor's license, prior <br />to the scheduled award date of the contract. Oak Engineering, Inc. (OEI) <br />has only a Class A, General Engineering Contractor's license. OEI did not <br />show its intention to obtain a C-10 license but instead submitted a <br />letter to the City protesting the licensing requirement. OEI contended <br />that a Class A contractor under California Business and Professional Code <br />would be qualified to perform work included in this project. Although <br />the Contractor could perform the work under class "A" license, the City <br />has the discretion to decide which classification is necessary for <br />bidding on a project. <br />This project is exclusively electrical work. Public Works staff has <br />determined that a Class C-10 Electrical contractor is more suitable for <br />this project than a Class A General Engineering contractor. Based on the <br />above, staff has determined that OEI's bid fails to comply with two <br />provisions of the bidding documents and therefore recommends OEI's bid be <br />treated as non-responsive. On March 21, 2006, a protest meeting was held <br />before the Executive Director of Public Works Agency and no new <br />information was provided by OEI to change our recommendation. The lowest <br />responsive bid was submitted by Moore Electrical Contracting, Inc., for <br />$223,121, which is above the Engineer's estimate of $207,500. <br />23A-2 <br />
