ANTI-PROSELYTISM PROVISION <br />2 No funds provided directly to institutions or organizations to provide <br />3 services and administer programs under 42 U.S.C. Section 604(a)(I)(A) shall be <br />4 expended for sectarian worship. instruction. or proselytization, except as <br />5 otherwise permitted by law. <br />6 15. SUPPLANTING GOVERNMENT FUNDS <br />7 CONTRACTOR shall not supplant any Federal, State or COUNTY funds <br />8 intended for the purposes of thi s Agreement wi th any funds made avai 1 ab 1 e <br />9 under thi s Agreement. CONTRACTOR sha 11 not c 1 ai m rei mbursement from COUNTY <br />10 for, or apply sums received from COUNTY with respect to. that portion of its <br />11 obligations which have been paid by another source of revenue. CONTRACTOR <br />12 agrees that it shall not use funds received pursuant to this Agreement, either <br />13 directly or indirectly, as a contribution or compensation for purposes of <br />14 obtai ni ng Federal. State or COUNTY funds under any Federal. State or COUNTY <br />15 program without prior written approval of ADMINISTRATOR. <br />16 16. BREACH SANCTIONS <br />17 Failure by CONTRACTOR to comply with any of the provisions. covenants, <br />18 or conditions of this Agreement shall be a material breach of this Agreement. <br />19 In such event ADMINISTRATOR may, in its sole discretion, and in addition to <br />20 immediate termination and any other remedies available at law, in equity, or <br />21 otherwise specified in this Agreement: <br />22 16.1 Afford CONTRACTOR a time period within which to cure the breach, <br />23 which period shall be established at the sole discretion of ADMINISTRATOR; <br />24 and/or <br />25 16.2 Discontinue reimbursement to CONTRACTOR for and during the period <br />26 in which CONTRACTOR is in breach, which reimbursement shall not be entitled to <br />27 later recovery; and/or <br />28 16.3 Offset against any monies billed by CONTRACTOR but yet unpaid by <br /> <br />(WBC0406) <br /> <br />22 of 37 <br /> <br />(4/19/2006) <br />
