INSURH,C~ NOT REQUIRED <br />WORK MAY PROCEED <br />_.g.ERKOF CO\J~CIL.~_.---BVSINESS-RELOCATION AGREEMENT-~------ <br />OATE: 6- ((p- 04:> <br />It is hereby understood and agreed by Johnson Chapel The African Methodist Episcopal <br />Church ("Claimant") and the City of Santa Ana ("City") that relocation assistance will be <br />provided as follows: <br /> <br />. <br /> <br />A-2006-1I 0 <br /> <br />The terms are as follows: <br /> <br />l. The City will rehabilitate and repair the building site located at 124 S. Bristol Street, <br />Santa Ana (hereafter referred to as the replacement site) in accordance with the attached <br />Scope ofW ork, identified as Attachment 1. The City will enter into a contract with Gates <br />Development Co. to complete said Scope of Work in a timely manner. <br /> <br />2. The relocation costs of $129,656 are considered a relocation claim by the Claimant, in <br />accordance with 49 CFR Part 24. Claimant authorizes payment of the relocation claim <br />directly to Gates Development Co., as specified in the Attachment 2. <br /> <br />3. Gates Development will assist the Claimant in relocating personal property located at <br />204 N. Bristol Street to the' replacement site. These moving costs are included relocation <br />claim outlined above. Claimant's occupancy at the replacement site will be in accordance <br />with a separate Non-Exclusive License Agreement. <br /> <br />4. Neither the City nor any employee, officer, or agent thereof shall be responsible for any <br />damage or liability occurring by reason of anything done or omitted to be done by <br />Claimant under or in connection with the agreement. It is also understood and agreed that <br />the Claimant shall fully indemnify and hold the City and their consultants, harmless for <br />any liability imposed by injury or damage to property occurring by reason of anything <br />done or omitted by Claimant in connection with this agreement. <br /> <br />5. All notices, requests, demands and other communications required or permitted to be <br />given under this Agreement shall be in writing and shall either be delivered in writing <br />personally or be sent by telegram or by regular or certified first class mail, postage <br />prepaid, deposited in the United States mail, and properly addressed to the party at its <br />address set forth below, or at any other address that such party may designate by written <br />notice to the other party: <br /> <br />To City: <br /> <br />City of Santa Ana Public Works Agency <br />Souri Amirani <br />20 Civic Center Plaza M-36 <br />Santa Ana, CA 92702 <br /> <br />To Tenant: <br />Johnson Chapel <br />Attn: Pastor Barta <br />P.O.
