. ~ °-° ~C ~26~a7 <br />"~ <br />AND AIR CONDITIONING, INC. <br />Feb. 26, 2007 <br />The City of Santa Ana Planning Commission <br />20 Civic Center Plaza <br />Santa Ana, CA 92702 <br />Re: HD Supply request for variance no. 07-01 <br />Please reference the Santa Ana Municipal Code: Chapter 41 Zoning <br />Article XV Off-street Parkins: <br />Please first reference Division 5 Industrial uses: <br />This Division describes "Industrial use" as Manufacturing, Wazehouse Distribution (specificallyexcluding <br />"sales at retail") and Lumberyards without building space <br />I have included pictures which clearly indicate the retail sales nature of Contractors Warehouse, aka HD <br />Supply. HD Supply is cleazly a retail sales establishment. Therefore, the retail sales requirements for <br />pazking apply, not the Industrial use which HD Supply is representing themselves as. <br />Please reference Division 3 Commercial and Office Standards <br />Sec. 41-1340 Retail Stores ... -requires 5 parking spaces for each 1,000 square feet of gross floor area. <br />Sec 41-1354. Lumberyards - 5 spaces for each 1,000 square feet of gross floor azea of building space. <br />The proposed HD Supply store has more than 88,000 square feet of building space. Therefore at 5 parking <br />spaces per 1,000 sq. ft. (retail requirement) they would require 440 pazking spaces For customer and <br />employee parking. HD Supply has provided for only 104 pazking spaces. They are more than 75% short of <br />the required amount of parking spaces for the retail business they intend to conduct at the 1044 E. 4th St: <br />location. <br />I am asking the Planning Commission to deny the HD Supply request for parking variance based on: <br />A. HD's mis-application of the Industrial pazking standard <br />B. Clearly this would be a retail sales establishment and is therefore subject to the Retail Sales parking <br />requirements <br />C. Their hereby demonstrated lack of required parking allowance for this proposed store location. <br />HDS and the City, if this variance application is approved, are mandating that the surrounding <br />business and residential community absorb their grossly under allowed pazking situation. This <br />azea is already severely impacted by a shortage of parking.
