1 Concealment, fraud. This entire p�shall be void if, whether
<br />2 before or after a loss, the insured wilfully concealed or mis-
<br />3 represented any material fact or circumstance concerning this
<br />4 insurance or the subject thereof, or the interest of the insured
<br />5 therein, or in case of any fraud or false swearing by the insured
<br />6 relating thereto.
<br />7 Uninsurable and excepted property. This policy shall not cover
<br />8 accounts, bills, currency, deeds, evidences of debt, money or
<br />9 securities; nor, unless specifically named hereon in writing,
<br />10 bullion or manuscripts.
<br />11 Perils not included. This company shall not be liable for loss by
<br />12 fire or other perils insured against in this policy caused, directly
<br />13 or indirectly, by. (a) enemy attack by armed forces, including
<br />14 action taken by military, naval or air forces in resisting an actual
<br />15 or an immediately impending enemy attack; (b) invasion;
<br />16 (c) insurrection; (d) rebellion; (e) revolution; (f) civil war;
<br />17 (g) usurped power; (h) order of any civil authority except acts
<br />18 of destruction at the time of and for the purpose of preventing the
<br />19 spread of fire, provided that such fire did not originate from any
<br />20 of the perils excluded by this policy; (i) neglect of the insured to
<br />21 use all reasonable means to save and preserve the property at
<br />22 and after a loss, or when the property is endangered by fire i t
<br />23 neighboring premises; (j) nor shall this company be liable for
<br />24 loss by theft.
<br />25 Other insurance. Other insurance may be prohibited or the
<br />26 amount of insurance may be limited by endorsement attached
<br />27 hereto.
<br />28 Conditions suspending or restricting insurance. Unless otherwise
<br />29 provided in writing added hereto this company shall not be liable
<br />30 for loss occurring (a) while the hazard is increased by any
<br />31 means within the control or knowledge of the insured; or (b)
<br />32 while a described building, whether intended for occupancy by
<br />33 owner or tenant, is vacant or unoccupied beyond a period of
<br />34 60 consecutive days; or (c) as a result of explosion or riot,
<br />35 unless fire ensue, and in that event for loss by fire only.
<br />36 Other perils or subjects. Any other peril to be insured against
<br />37 m subject of insurance to be covered in this policy shall be by
<br />38 endorsement in writing hereon or added hereto.
<br />39 Added provisions. The extent of the application of insurance
<br />40 under this policy and of the contribution to be made by this com-
<br />41 pany in case of loss, and any other provision or agreement not in-
<br />42 consistent with the provisions of this policy, may be provided for
<br />43 in writing added hereto, but no provision may be waived except
<br />44 such as by the terms of this policy or by statute is subject to
<br />45 change.
<br />46 Waiver provisions. No permission affecting this insurance shall
<br />47 exist, or waiver of any provision be valid, unless granted herein
<br />48 or expressed in writing added hereto. No provision, stipulation
<br />49 or forfeiture shall be held to be waived by any requirement or
<br />50 proceeding on the part of this company relating to appraisal or
<br />51 to any examination provided for herein.
<br />52 Cancellation of policy. This policy shall be canceled at any time
<br />53 at the request of the insured, in which case this company shall,
<br />54 upon demand and surrender of this policy, refund the excess of
<br />55 paid premium above the customary short rates for the expired
<br />56 time. This policy may be canceled at any time by this company
<br />577 by giving to the Insured a five days' written notice of cancellation
<br />80 Pro rata lilfty. This company shall not be liable for a
<br />81 greater prop M n of any loss than the amount hereby insured
<br />82 shall bear tote whole insurance covering the property against
<br />83 the peril involved, whether collectible or not.
<br />84 Requirements in case loss occurs. The insured shall give wW
<br />85 ten notice to this company of any loss without unnecessary de-
<br />86 lay, protect the property from further damage, forthwith sepa?
<br />87 rate the damaged and undamaged personal property, put it In
<br />88 the best possible order, furnish a complete inventory of the de.
<br />89 stroyed, damaged and undamaged property, showing in detail
<br />90 quantities, costs, actual cash value and amount of loss claimed;
<br />91 and within 60 days after the loss, unless such time is extended
<br />92 in writing by this company, the insured shall render to this com-
<br />93 pany a proof of loss, signed and sworn to by the insured, stating
<br />94 the knowledge and belief of the insured as to the following: the
<br />95 time and origin of the loss, the interest of the insured and of all
<br />96 others in the property, the actual cash value of each item thereof
<br />97 and the amount of loss thereto, all encumbrances thereon, all
<br />98 other contracts of insurance, whether valid or not, covering any
<br />99 of said property, any changes in the title, use, occupation, loca-
<br />100 tion' possession or exposures of said property since the issuing of
<br />101 this policy, by whom and for what purpose any building herein
<br />102 described and the several parts thereof were occupied at the
<br />103 time of loss and whether or not it then stood on leased ground,
<br />104 and shall furnish a copy of all the descriptions and schedules in
<br />105 all policies and, if required and obtainable, verified plans and
<br />106 specifications of any building, fixtures or machinery de-
<br />107 stroyed or damaged. The insured, as often as may be reason -
<br />108 ably required, shall exhibit to any person designated by this
<br />109 company all that remains of any property herein described, and
<br />110 submit to examinations under oath by any person named by this
<br />111 company, and subscribe the same; and, as often as may be rea-
<br />1 12 sonably required, shall produce for examination all books of
<br />113 account, bills, invoices and other vouchers, or certified copies
<br />114 thereof if originals be lost, at such reasonable time and place as
<br />115 may be designated by this company or its representative, and
<br />116 shall permit extracts and copies thereof to be made.
<br />117 Appraisal. In case the insured and this company shall fail to
<br />118 agree as to the actual cash value of the amount of loss, then, on
<br />119 the written demand of either, each shall select a competent and
<br />120 disinterested appraiser and notify the other of the appraiser
<br />121 selected within 20 days of such demand. The appraisers
<br />122 shall first select a competent and disinterested umpire; and fail -
<br />123 ing for 15 days to agree upon such umpire, then, on request of
<br />124 the insured or this company, such umpire shall be selected by a
<br />125 judge of a court of record in the state in which the property cov-
<br />126 ered is located. The appraisers shall then appraise the loss,
<br />127 stating separately actual cash value and loss to each item; and,
<br />128 failing to agree, shall submit their differences, only, to the um-
<br />129 pire. An award in writing, so itemized, of any two when fled
<br />130 with this company shall determine the amount of actual cash
<br />131 value and loss. Each appraiser shall be paid by the party
<br />132 selecting him and the expenses of appraisal and umpire shall
<br />133 be paid by the parties equally.
<br />134 Company's options. It shall be optional with this company to
<br />135 tae all, or any part, of the property at the agreed or appraised
