"Bylaws" means the Bylaws adopted by the Association, including any amendments or <br />additions thereto. <br />"City" means the City of Santa Ana, a California charter city and municipal corporation. <br />"Code" means the Internal Revenue Code of 1986, as amended, including the <br />Regulations promulgated thereunder or under any predecessor statute. <br />"Common Area Improvements" shall mean physical improvements to real property <br />which improvements are owned, maintained, and operated by the Association. <br />"Common Improvement Areas" shall mean certain improvements to real property and <br />portions of legally separate real properties specifically designated for common use by all Owners, <br />tenants, occupants and residents, as defined herein by description and/or graphic exhibit on <br />Exhibit "B" attached and incorporated hereto. <br />"County" means the County of Orange, California. <br />"Declaration " means this Declaration of Conditions, Covenants, Restrictions and <br />Easements, together with any amendments, supplements or modifications hereto, <br />"Deed of Trust" shall mean and be synonymous with the word "mortgage," and the same <br />may be used interchangeably with the same meaning; and likewise, the word "trustor" shall be <br />synonymous with the word "mortgagor," and the word "beneficiary" shall be synonymous with <br />the word "mortgagee," <br />"Low Income Tenant" means a person or family with Adjusted Income, determined as of <br />the date of initial income certification for existing tenant and for new tenants occupancy by <br />reference to the income certification process described in Section [4.4], that does not exceed <br />eighty percent (80%) of the Median Income for the Area, adjusted for family size. (Note: In <br />June 1999, eighty percent (80%) of the Median Income for a family of four is $54,640 per year.) <br />"Median Income far the Area " means the median income for the Area as determined <br />and published annually by the Secretary of Housing and Urban Development under Section 8 of <br />the United States Housing Act of 1937, as amended, or if programs under Section 8 are <br />terminated, median income for the Area determined under the method used by the Secretary prior <br />to such termination.
