General Procedures for Handling Non -Criminal Violations of the Act <br />The following procedure is promulgated to meet the requirements <br />Title <br />f and Sethe dCtion <br />e of <br />Federal Regulations, Section 667.600 through 667.E40 of the WIA regulations, the State and <br />181(c) of the Act (Public Law 105.200: 29 U.S. Code Sec. 2931 et seq.) <br />at LWIA level for the receipt, investigation, hearing, nd res financial dn of co plaints by WI unions, <br />participants, subrecipients, applicants for partpa <br />community based organizations, or any other persons. <br />These procedures provide for resolution of non -criminal complaints arising from the <br />operation of the Santa Ana LWIA. <br />A complaint is defined here as a written expression by a party alleging a violation of the <br />Act, regulations promulgated under the Act, recipient <br />and conditions greements, or of employment such <br />her <br />specific agreements under the Act, including m <br />participants in employment training programs. All complaints, amendments and <br />withdrawals shall be in writing. These procedures are intended <br />to with WIolve matters which <br />A programs operated <br />concern policies, procedures or action(s) arising in connection <br />by each LWIA grant recipient and subrecipient under the Act. <br />These procedures shall not be construed as affecting any other available legal remedy <br />outside of the WIA complaint process (i.e., disputes regarding terms and conditions of <br />employment of any employee who is not a participant), either separately or simultaneously, <br />that a person may wish to pursue in the resolution of a non-WIA complaint.
