The proposed Montage multi-family residential use at 100-130 <br />East MacArthur Boulevard will not provide a facility that will <br />contribute to the general well being of the surrounding <br />community. The project developer has not established a <br />development track record in the City, which has resulted in <br />concerns with the potential quality of the Montage project. <br />Since the project has yet to be constructed, it is likely that the <br />project will not be a high-quality residential housing <br />development, thereby affecting the property values of the <br />surrounding neighborhoods and adversely impacting the <br />general well being of the community. <br />2. Will the proposed use under the circumstances of the particular case <br />be detrimental to the health, safety, or general welfare of persons <br />residing or working in the vicinity? <br />The proposed multi-family residential use will be detrimental <br />to the general welfare of persons residing and working in the <br />area. Concerns with the potential quality of the Montage <br />project and the lack of strong property management of a rental <br />project will result in a lesser quality project that will adversely <br />impact the welfare of the adjacent Sandpointe Neighborhood. <br />3. Will the proposed use adversely affect the present economic stability <br />or future economic development of properties surrounding the area? <br />The proposed project will adversely affect the economic <br />stability within the MacArthur Place South development area <br />and the adjacent Sandpointe Neighborhood. Due to a <br />reduction in quality associated with the construction of a rental <br />project and potential issues with the future management of the <br />rental project, the Montage development will negatively impact <br />the present economic stability of the area. <br />4. Will the proposed use comply with the regulations and conditions <br />specified in Chapter 41 for such use? <br />The proposed use would be in violation of the express terms <br />of the Development Agreement adopted, pursuant to Chapter <br />41 and State law, for the project. The Development <br />Agreement, which was signed by Integral's predecessor in <br />interest and recorded against the property at the time Integral <br />acquired it, does not permit apartments, but instead requires <br />for-sale condominiums to be built on the property. <br />5. Will the proposed use adversely affect the General Plan or any <br />specific plan of the City? <br />The proposed project will adversely affect several goals <br />identified in the General Plan of the City. Goal 1 of the <br />General Plan encourages a balance of land uses to address <br />Resolution No. 2009- <br />Page 2 of 4 <br />75A-161 <br />
