basic community needs and Goal 3 promotes the <br />preservation and integrity of existing neighborhoods. The <br />construction of a rental project will not be consistent with <br />these goals as several apartment projects are located in the <br />immediate area, with for-sale housing needed to provide a <br />balance of land uses. Further, the pride of ownership <br />associated with for-sale housing results in better quality <br />projects that improve the character of adjacent <br />neighborhoods. <br />Section 2. The City Council of the City of Santa Ana after conducting the public <br />hearing hereby: <br />1. Denies the application of Integral Communities, I, Inc. to amend Development <br />Agreement No. 2005-02; and <br />2. Denies the amendment to Conditional Use Permit No. 2005-15 as for the <br />property located at 100-130 East MacArthur Boulevard. <br />These decisions are based upon the evidence submitted at the abovesaid <br />hearing, which includes but is not limited to: the Request for Council Action dated May <br />4, 2009 and exhibits attached thereto; and the public testimony written and oral, all of <br />which are incorporated herein by this reference. <br />Section 3. This decision rendered by the City Council of the City of Santa Ana <br />is final and is subject to judicial review pursuant to California Code of Civil Procedure <br />section 1094.6. The Clerk of the Council shall give direct notice to the applicant of the <br />Council's decision and these findings. <br />ADOPTED this day of May, 2009 <br />Miguel A.
