11.2.1.1. As to the alleged illegal operation of a Taxicab, the <br /> date, time and location of the alleged illegal <br /> operation, and information indicative of a Taxicab <br /> operation (such as advertising a Taxicab service on <br /> the vehicle and/or picking up passengers at a location <br /> reserved for Taxicab service or other such indicative <br /> information); information pertaining to the type of <br /> vehicle involved (sedan, van, station wagon), the <br /> vehicle's license plate number, color, make, model, <br /> and any distinctive characteristics, if any (such as <br /> signs, markings, condition or visible damage to the <br /> vehicle). The absence of distinctive characteristics <br /> shall not be a basis for not pursuing an investigation <br /> into the alleged illegal operation of a Taxicab. <br /> 11.2.1.2. As to an alleged violation of Government Code <br /> Section 53075.9 pertaining to advertising, a copy or <br /> exemplar of the advertising information (such as the <br /> sign, business card, advertising display, webpage, <br /> electronic recording or phone directory) evidencing <br /> non-compliance with the statute. <br /> 11.2.2. The person providing the information in subsection 11.2.1 above <br /> shall provide his/her identity and be available to testify in <br /> administrative proceedings pertaining to the alleged violation. The <br /> identity of members of the public shall not be released under Public <br /> Records Act requests, but shall be available to parties against <br /> whom the proceedings are brought. <br /> 11.3. OCTAP Administrator Review and Authority. <br /> 11.3.1. Upon review of the information required hereunder, and if the <br /> OCTAP Administrator or designee determines that the evidence <br /> warrants it, the OCTAP Administrator or designee may notify the <br /> alleged offending Company and/or Driver of the alleged violation <br /> evidenced by the information, and give notice of, and hold within 60 <br /> days of such notice, an administrative hearing to consider the <br /> Company's and/or Driver's response to the evidence of violation, <br /> and to consider the imposition of administrative penalties for the <br /> violation pursuant to Government Code Section 53075.9(c), and an <br /> assessment sufficient to cover the reasonable expense of <br /> investigating the violation. Within ten (10) days of the <br /> administrative hearing, the OCTAP Administrator or designee shall <br /> notify the Company and/or Driver in writing of his/her decision.
