Administrative Plan 7/1/2025 Page 16-35 <br />Late or Missed Payments <br />SAHA Policy <br />If a payment is not received by the end of the business day on the date due, and prior <br />approval for the missed payment has not been given by SAHA, SAHA will send the <br />family a delinquency notice giving the family until the next scheduled payment to make <br />the note current. If the payment is not received by the second and final due date, it will be <br />considered a breach of the agreement and SAHA will proceed with proposed termination <br />of assistance in accordance with the policies in Chapter 12. <br />For families requesting to exercise portability, all debts owed to SAHA must be paid in <br />full prior to SAHA approval of portability. <br />No Offer of Repayment Agreement <br />SAHA Policy <br />SAHA will not enter into a repayment agreement with a family if the family has a current <br />or past repayment agreement. Any amount that is owed by the family will need to be <br />paid in full within 60 days of meeting with SAHA to sign acknowledgement of debt <br />owed. Family may request an extension due to financial hardship for an additional 30- <br />days. <br />Repayment Agreement Terms <br />All repayment agreements must be in writing, dated, signed by both the family and the PHA, <br />include the total retroactive rent amount owed, any amount of lump sum payment made at time <br />of execution, if applicable, and the monthly repayment amount. Notice PIH 2018-18 requires <br />certain provisions, at a minimum, be included in any repayment agreement involving amounts <br />owed by a family because it underreported or failed to report income: <br /> A reference to the items in the family briefing packet that state the family’s obligation to <br />provide true and complete information at every reexamination and the grounds on which the <br />PHA may terminate assistance because of a family’s action or failure to act <br /> A statement clarifying that each month the family not only must pay to the PHA the monthly <br />payment amount specified in the agreement but must also pay to the owner the family’s <br />monthly share of the rent to owner <br /> A statement that the terms of the repayment agreement may be renegotiated if the family’s <br />income decreases or increases <br /> A statement that late or missed payments constitute default of the repayment agreement and <br />may result in termination of assistance <br />EXHIBIT 1
